    You would have agreed to the T&C when you took the contract out, if it was over the phone you would have been asked, if it was online there would have been a tick box.


    Verbal contracts carry the same weight as written ones just are harder to recall and prove later.

    Sorry that's irrelevant. You are on T-Mobile , What Orange may have done is not relevant. Yes they are the same parent but at the time were different companies with different T&C.




    You need to find a copy of your T&C that you agreed at the time you signed up (as they change form time to time) to. Any other dated copies from T-Mobile or what Orange, EE or even O2 or Vodafone did is not relevant.

    At all networks (except Orange*) the ETC has always been calculated as the cost of the notice period or the remainder of the minimum term, whichever is bigger. The only difference was so called 'VAT', i.e. some networks gave 1/6 discount.


    T-mobile are notorious for trying to rob all their leaving customers, but always refund the deceptive charges if a robbed customer has guts to challenge them.

    You were able to dispute the T&C's at the time should you wish but 24 months later is a bit late.
    There is no mention of how the charges are calculated or arrived at but again it should have been disputed at the time if you didn't agree for them to be able to enforce a charge.

    All charges are normally available in a separate document. If the OP doesn't have it, then T-mobile have to provide it on request. As simple as that.
    I am sure that the document will say the same as I said in my previous post.

    I don't doubt it, but the poster was pointing to an Orange document to try and work out T-Mobile charges. T&C change over time, and the OP needs to find the ones he signed up to, probably by asking TM, Google may find copies of TM's T&C but that does not mean the ones Google finds will be the ones in force at the time the OP signed up.

    The T&C's the OP signed up to are linked in my post #3 and quoted from in post #14


    There will have been details of the price plan for information purposes at the time which no doubt may mention how outstanding line rental is calculated, but whether it will mention a cancellation charge cost is doubtful.

    ‘Cancellation Charge’ the Charge which totals the rest of the Monthly Charges for the remainder of the Minimum Term, discounted by 4%;
    defined in document, everything seems to be defined in T&C -
    even this:
    'UK’ the United Kingdom of Great Britain and Northern Ireland;

    getting back money, from price plane changes is only first example that denies it
    and as I mentioned - billed penalties are not in contract, so indeed dispute doesn't relate to t&c just something that isn't there


    all in all,
    called... spent 26 minutes on telephone, for a representative to hung up, after I asked for copies of documents related to penalties incurred [this was only regular call to TM]

    second call...
    this time I called straight to complain dept, as I was going ready to get it to Cisas. I only asked about those documents once again [I don't ever do shouting], and didn't even mention refund - in 2 min all was done.

    Also for all formal calls I use this
