Parking Eye CCJ

Hi all,
I have just recieved a letter in the post from Parking Eye, it states the following:
"Date Of Event: 18th April 2014"
"Claim number: xxxxx"
£185.00
I moved house on June 27th; this is the first I've seen of this, apparently they claim to have sent post to my previous address informing me about a parking fine but I have never seen any of these letters. I just checked my credit report and seen the CCJ, it was issued on 5th August 2014.
How can I get this CCJ removed? What first steps should i take? Contact the court? respond to ParkingEye?

I have just recieved a letter in the post from Parking Eye, it states the following:

Dear sir/madam,
Parking Eye has previously written to you at the address you had registered with the DVLA at the time of the parking event. However, it has come to our attention that you no longer live at this address but reside at the above address. This new address has been supplied to ParkingEye by a credit reference agency. For further details of this please see the reverse of this letter.
Parking Eye aquires its registered keeper details from the DVLA. It is the duty of the registered keeper to ensure that they update the DVLA with any new addresses. Because this had not been changed, ParkingEye has sent numerous pieces of correspondence to an incorrect address. This included a notice to keeper, two further notifications and a letter before county court claim.
ParkingEye could not have reasonably known you were at a different address and therefore having not recieved any response to the above correspondence ParkingEye issued a county court claim to the registered keepers address. Subsequently we requested judgement on this claim.
We are therefore notifying you that there is currently a county court judgement on your credit record. An outstanding CCJ can adversley affect your ability to gain credit and will damage your credit score/rating. We therefore require payment of £185.00. Once this payment has been recieved we will notify the county court business cetnre as soon as possible to ensure that the CCJ is marked as "satisfied". This will improve your ability to gain credit.

You can apply to have it set aside, and then the hearing will have to be re-heard and for this there is a cost if you win the hearing you will get all of your money back, if you loose then you will have to pay the set aside fee+parking eyes 185.
You can and should also mount a strong complaint to the landowner. Depending on who the landowner is/what car park you parked in this may be one avenue to go down in terms of getting your money back.From the Plain Language Commission:

I received the exact same letter today. I still have access to the address the car was registered to and like Junglist_matty, I've received no previous correspondence. Complete scam.
I've checked my credit report on Experian but there is no CCJ showing.
I guess I'll follow the MSE guide and appeal.0 -
Some interesting information:
Parking Eye could not realistically issue a claim for every ignored ticket; there would be too many, and it would cost them too much (NB. for cases that reach court, Parking Eye lose money on solicitors costs even if they win the case). However, if you do ignore a ParkingEye ticket, you could well be one of the unlucky ones.

Oh, and I just checked around and also just found out that parking limit is 3 hours for this retail complex (I don't have a clue how long we overstayed because I've never seen any other post from ParkingEye). Considering the retail park contains the following stores:

Hobbycraft

I can't see how 3 hours is not a reasonable time limit; we were in the process of moving house, at the time when the fine was issued. So we obviously spent a lot of time at these various home stores looking for furnishings for our new house.

Seems I'm one of the unlucky ones, but there's not a hope in hell I'm paying the fine, I'm taking the b*'~#@ds to court and hopefully they'll just end up loosing more money for being scumbags!

Errr that would be a waste of time.
If you have a CCJ it might not be updated with Experian yet.
So you would need to get it set aside.
That will cost you £150.00

I have just received an application form to apply to have the CCJ set aside.
I have never responded to Parking Eye (they say they sent post to my old address) and I haven't responded to a letter sent by the court (as it was sent to my old address).
What are the realistic chances the court will agree I was not in a position to defend myself against the CCJ and have it removed from my record?

I have filled out the application form to have the CCJ set aside and stated the reason for this being that I didn't receive the original claim papers after moving address.
Now before I send this in the post, I would really appriciate some clarification:
1. I pay £155 to apply to have the CCJ set aside
2. If my application is successful I get a re-hearing
3. At the re-hearing:
3a. If I win I can claim back the £155 application fee (how?)
3b. If I win the CCJ is removed from my file and the £185 "debt" is cleared
3c. If I lose, I lose the £155 application fee and I pay the £185 "debt". But what happens to the CCJ? If I pay the £185 immediately after the re-hearing does the CCJ get removed as it's been paid within 28 days?

The CCJ will be satisfied if you pay within the 28 days and it won't affect you. There's a bit of a debate about whether that counts as "recieving a CCJ" for the purpose of credit history, but most likely is that it doesn't unless you fail to pay. It's safe to assume that anything Parking Eye says to you is stretching the truth.0
