UKPC - offering me £15 per ticket

    But sadly they state legally I've signed a contract/lease which agrees to schemes such as UKPC. I'm not sure I have a real case and can get out of this.

    This would be on a much broader footing, and for the future, not to get your PCNs cancelled. It would make sure none of the residents are faced with this rubbish in the future. Surely the MA is working on behalf of its residents?

  • Thank you. Yes, the MA are meant to be working on behalf of the residents yes, I'm curious as to whether they recieve a kick-back for tickets though... Trinity are the client and have the power to cancel these charges.

    I'll write a strongly worded response and say (again) that I don't wish to hear from UKPC again and stress their ruining the 'quiet enjoyment' of my property and harassing me. Then I'll ignore.

    Hello again. I've drafted my response below to my M.A As UKPC won't cancel the tickets. Any suggestions/amends?

    Hi Jennifer

    Thank you for getting back to me and clarifying. I appreciate that you’re appealing to them too and as you suggest, I will also send the below to UKPC. I’ve spoken with them various times since June and find them rude and aggressive and therefore I can’t imagine they’ll cancel the tickets, but it’s worth a final appeal.

    I am all in agreement that the car park needs to be enforced being that close to a station but it needs to be there to protect the residents, not make money off them. And I assure you, UKPC are there to make money, and as much money as possible. However for every POPLA appeal I make, I believe UKPC will have to pay £27 so I will gladly take all 4 x tickets up with POPLA.

    By virtue of the fact that their charges at this car park have been found by POPLA as 'not representing a genuine pre-estimate of loss' it follows that the PCNs are non-compliant and unenforceable. Further, I will contend in my POPLA appeal that UKPC has no legal title in the land, nor a BPA-compliant landowner contract that assigns any right to pursue these charges through the courts in your own name. UKPC produced no evidence to the contrary which once again, renders the PCNs non-compliant and unenforceable. In other words, an unwarranted threat.

    Furthermore, continued correspondence from UKPC or the Debt Recovery Agency relating to any supposed claim for the parking of my vehicle on my own property, which is in effect a breach of my right to quiet enjoyment of my property, will be deemed harassment and again court action may be taken against them.

    Far too polite IMHO! As you know, I would send a really strong letter like the one I wrote in tospig's thread. You appear to be losing sight of the facts here. UKPC have no case. You do. And yet after all the advice you got at first you were believing the knock-back the agent sent and thinking you had no choice but to pay. Forget that!

    I would send a Letter before claim (like the one in tospig's thread) or a very very strongly-worded complaint at the very least. No please, no thankyou.

    However you appear to be talking about PCNs issued to 4 different registered keepers so WHY are you thinking you can appeal them? you can't - only ONE is yours isn't it? Are you really thinking you can argue your builder's case? You can't. It's his PCN to ignore if he's been DAFT enough not to appeal it and win, same for all the others. Why did no-one just read their stupid 'PCN' and see how to appeal and then Google POPLA appeals to get here sooner when it would have been so easy to cancel. No-one seems to have done that and are you now all past the appeal window because of that? If you are the only person who has been complaining about all 4, then stop. All 4 recipients should be sending a separate complaint/LBC letter. These are not your PCNs - not your battle except the one that was on your car.

    You will all be fine to ignore these fake PCNs (as long as you don't ignore any real court papers in the future so KEEP all letters for up to 6 years to be sure) if you've all missed the POPLA appeal chance. Why the heck did people just complain to the agent and phone, when that's NOT how to appeal...what a waste of an easy chance to cancel them all at POPLA.

    Never mind! No big deal, these aren't fines. Worth more complaints though.

    Errrrmmmm...seriously? You plan to write that you AGREE the scammers are needed? No-one here is likely to agree. What's wrong with a lockable gate or a simple lockable parking post or two? Google them. Using a PPC is like using a bouncer to guard your open house rather than simply getting a front door!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
