Good stuff, glad to see you are on the case. I just posted the link to the tospig thread 'POPLA test' on another UKPC thread here near yours. post #30 of it has the sort of letter I recommended as a 'Letter before Claim' to get them to shut up or be sued.

    I've just been looking - would that be this letter?

    I am not liable for the charge as UKPC Ltd have not shown they have either:

    1. Written authorisation of the landowner to pursue outstanding parking charges;
    2. A contract with the landowner that bestows them (UKPC Ltd) with the authority to make a contract with a driver who has parked on the land.

    UKPC Ltd must show their contract, which also must be BPA compliant to demonstrate that they:

    1. Are allowed to pursue outstanding parking charges;
    2. Have the authority to make a contract between themselves and the appellant.

    What? You appear to be quoting from a POPLA appeal not the letter in post #30 of tospig's thread 'POPLA test'. I am confused.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Sorry, my fault, I've now found it and I'm reading through. Very comforting.

    Now that I'm refusing the reduced cost of each ticket, do I just wait and see if they threaten to take me to court? What are the next steps?

    You havent said much about the circumstances of why the tickets were issued.
    You live in a block of flats, do you have an allocated space or spaces for that flat? its usually in with your tenancy/rental/lease/freehold documents.

    You also said this in a letter to the management company:
    Bearing this in mind, I will no longer participate in their scheme, UKPC must cease and desist from harassing me, and that any further trespasses could lead to a claim for trespass against them and their parking ‘wardens’. The purpose of these companies should be to make matters easier for leaseholders, not to harass them.

    You should make it quite clear that if the management company do not instruct UKPC who are acting as the management company's agents then you will be holding the management company jointly liable as principle for the actions of their agents - UKPC.

    This website may also be of help to anyone who has paid UKPC as a means to possibly get their money back, if UKPC dont stump up and refund people then the management company may be liable to refund those who have paid UKPC http://www.challengethefine.com/

    Thank you very much, to confirm I am allocated a space within my block of flats. My ticket and my Mum’s ticket were issued as we hadn’t had the permits sent through when I first moved in. We were parked in my bay which I own the leasehold to, but alas no permit on display.

    My builder was parked in a visitor bay with a clear letter explaining he was working on my flat and we were awaiting visitor passes. My friends ticket was issued at 4.30am on a weekend, there were no free visitor bays and they parked against the wall, obstructing nobody and causing no issue for anyone at that time. Unfair I'd say...

    I know you have asked the management agency not to pass on your mothers invoice number, but I would have refused point blank to give it them. Do you really trust them not to? And if they have lost it, then they can't try and charge you for it.

    Also, if they are reducing the invoice to £15 for a short period from a £100 then how can this possibly be a GPEOL? (We all know it's not...)

    Thank you, what's GPEOL?
  • My management company have come back with the following - essentially telling me I have to pay the fines. Thoughts? Should I just pay?

    1. My Colleague has written to our contact at UKPC to enquire as to whether there is a possibility that the parking fines you have been issued for not displaying a valid parking permit in your vehicle can be cancelled or reduced. We will let you know their response.
    2. As well as our involvement on your behalf, UKPC also have an appeals telephone number and address which you can utilise.

    3. It is evident from the signs up around the development that there is parking enforcement on site. This scheme was introduced by Trinity estates to both stop commuters from the station opposite, using residents parking bays but also to stop the estate from being used as a car park by local business whom used to park their commercial vehicles on site over night, hence the introduction of 24 hour parking enforcement. Both issues used to be a problem which has now greatly improved hence we believe that parking enforcement is right for the estate.

    4. The parking enforcement scheme is something that either your Solicitors or Genesis Housing Association should have made you aware of when you took ownership of the property. It is then residents responsibility to ensure that a parking permit is purchased and displayed at all times.

    5. Your parking bay has been allocated to your under the terms of your lease for the duration of your lease. The land is owned by Fairhold Atlas Limited, the Freeholder of the land.
    6. Trinity are the named managing agents of the development whom manage the site on behalf of the land owner Fairhold Atlas under the terms of the lease and as such have the right to introduce contracts / schemes to benefit the estate. You have signed a lease stating that you adhere to it’s terms with Trinity Estates being the Managing Agents and therefore, agreeing to schemes implemented by Trinity. This is your legal contract. Genuine pre estimate of loss , it shoots them in the foot as on one hand they claim its £100 , then it's £15

    If the intention is to keep non residents off the site, not penalise residents, then you should be pressing the MA to have the PPC use a 'white list' of residents' VRM plates, which will stop all this rubbish.

    Surely the MA would have no problem in getting this resident-friendly solution in place? Unless of course they are being incentivised not to do so!

    Some searching questions for you to be asking.
