Post 2006 charges

Hello,
I am using Martin's guide to reclaiming unfair credit card charges. I have dug out as many of my old pre 2006 statements as possible. I also applied to my credit card company for past six years of statements and they have sent them to me. However, these date from 2008 onwards and the charges on some of them are as follows
- Late payment charges £12.00
- returned direct debit charge £12.00
- overlimit charge £12.00
Am I able to apply for a refund on these kinds of charges? I understand the OFT recommended charge is £12.00 and from 2008 onwards I have been getting charged this amount. Some months all 3 of the above charges have been applied meaning I have been charged £36 in total that month.
My older statements show charges of £20 at a time so clearly above the recommended amount but just want to know if I am eligible to claim for the £12.00 charges.

Three very different charges but the same amounts. So, its not unreasonable to be charged three times for the three lots of work you have created.Am I able to apply for a refund on these kinds of charges?
They are within the OFT limit. So, cant see why the provider would entertain a request to refund. Older ones with higher amounts yes, but these dont seem to have any justification for refund.I am an Independent Financial Adviser (IFA). Thanks for the reply. That is what I was thinking too. I am just confused by the section in Martin's guide which states:
How much should I ask for?
Charges after June 2006. For any charges on or after June 2006, you were probably hit for £12 each time. As this is already set to the OFT-recommended amount, you simply need to ask for the full £12 amount to be refunded.
I read this as asking for the full £12.00 to be refunded??0 -

As an alternative suggestion to the normal banking 'defenders' on this site - Yes you can ask for the £12.00 fee's to be refunded along with interest as charged to you ! Normally the Card providers will not refund these charges of £12.00 however if you proceed via the small claims court you
will win - The credit card company will not want to get these charges examined in the court hence the normal 'Goodwill gesture payment' just
prior to the court date.0 -

Thanks for replies. Much appreciated. Has taken me most of the day so far to get through all the statements I have which date back to 2001. Charges there go from £15 - £30. Just trying to work out what to claim for as if you haven't done anything like this before - it can be complicated to start with. Getting the hang of it now though. Very grateful for this website and forum however!

The banks won the "unfair" charges court case in 2009, they will reject any attempt to reclaim fees if you start making reference to that sort of thing. You may indeed get nothing at all based on this court case. If you are in financial hardship now explain this to the bank and see what they offer you e.g. a few months charges maybe - don't expect to get all the charges since 2006 back.
Ignore Brown1950's advise unless he/she is willing to pay your court case fees and cover any losses if the bank defends the action - you do not want to take court action.Sam Vimes' Boots Theory of Socioeconomic Unfairness:

I talk from experience when collecting these credit card penalty charges- Issue proceedings in the small claims court - you will get your money back plus interest plus costs- Just Google The Consumer Action Group website and you will see how its done. Unless your Particulars of claim are wrong no credit card company will defend this type of action.0 -
