Can I insist on a return address in the UK?

I've bought an item over the internet, from Kickstarter, that I'd like to return. I'm within fourteen days of receiving the item, so I emailed asking where to return it to. I've been given an address in Spain.

The postage to Spain would cost me much of the money I'd get back from returning it. It was bought in the UK and is covered by the Consumer Contracts Regulations (which replaces the old Distance Selling Regulations), so don't they have to give me a UK address?

Have you got a link to the website you bought from? I've just searched for kickstarter and only came up with one american based site for backing projects and one german site which is a motoring accessories shop.

As both are based outside the UK then they don't have to provide a UK return address.

Doesn't look like a UK company to me.

Priced in Euros... no contact address...

How did you decide it's a UK company?

    I didn't decide that:

"It was bought in the UK..."

I'm just asking if they have to provide a UK return address

Well I made the assumption that you had decided they were UK based, given that you told us in no uncertain terms that The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply.

If they are not UK based, then UK based legislation does not apply.

You need to work out where they are trading from.

What really matters is where it was bought FROM (as in where the retailer is based), not bought IN (as in where the buyer is based).

    11. Applicable Law and Jurisdiction

Both parties expressly agree that Spanish law will govern this Contract. Any dispute arising between the Parties relating to the interpretation, execution or elimination of these TCSE will be submitted to the competent Courts and Tribunals to consider such matters as they apply to consumers, in the place where such obligation is to be carried out or the purchasing party’s place of domicile. If the purchasing party is domiciled outside Spain, both parties agree without exception to submit to the Jurisdiction of the Courts and Tribunals of the City of Madrid (Spain).
