                    Hi guys.
After reading few topics from your forum I decide to post my own one to get a bit of help and advice.
3 days ago I received a 'parking charge notice' from Vehicle Control Services Ltd (private company) - I'm unable to post a picture because a new users on this forum are not aloud to instert any links I have parked on Doncaster Airport where is 15 mins free parking and managed to collect my family in 15 mins. When I was leaving car park, just after a barrier my 2-years old daughter started coughing badly so I immediately stopped a car on left hand side on a some kind of bay to check if she is ok. I didn't even realize I can't park there. I stopped the car due to sort of 'emergency situation' and after literally maybe 30 sec when I checked that my daughter is ok I did back on the road and drove away.

I didn't wait there to collect someone, I didn't block anyone I just stopped there for 30sec to check my child. At the result I received 60 pounds (would be 100 pounds if I not pay in 14 days) ticket.
Can you give me some advice guys? Should I pay or appeal? If appeal what I should write in my appeal? 60-100 pounds it's a lot of money for me, someone who has 2 kids knows about it smile.gif
Please help.

Read the newbies thread, you should win this easily even though it'll be an IAS appeal.Je suis Charlie.0

This is one IAS appeal worth trying because the PCN talks about 'breach' and VCS have only just joined the IPC. So you need to simply spend a busy weekend reading the IAS Decisions thread and the links in post #3 of the Newbies thread about IAS appeals which have won, where the PCN is about a 'breach'.
Firstly the keeper can send the template in the newbies sticky thread:

hthPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

 Ok, thx.
So far I gonna use template letter from this forum, appeal to VTS and see what's happened next.0

This is what I sent:"I challenge this 'PCN' as keeper of the car, on the following grounds:
a). The sum does not represent a genuine pre-estimate of loss, nor is it a core price term. It is an unrecoverable penalty and not commercially justified.
b). The signage is insufficient, the risk of a charge is not transparent and the wording is ambiguous.
c). There is no evidence that you have any proprietary interest in the land.
d). Your written 'notice' fails to comply with the POFA 2012.
e). There was no consideration nor acceptance flowing from both parties and any contract with myself, or the driver, is denied.
The purpose of this communication is threefold:
 1. Formal challenge
There will be no admissions as to who was driving and no assumptions can be drawn in the absence of evidence. As such, you must either rely on the POFA 2012 or cancel the charge if you cannot claim keeper liability. Please uphold this challenge or send a rejection letter, so I can escalate this appeal to the independent appeal service offered by your Trade Body.
 2. ''Drop hands'' offer
The extravagant 'parking charge' is baseless but I realise that you may have incurred nominal costs. Equally, I have incurred costs to date, for researching the law, reading your Notice and responding, despite a lack of contract. I calculate both my costs and yours to be under £15 at this early stage, therefore, this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the spurious charge within 35 days without further expense and I will not pursue you for my costs. If you persist then I will charge in full for my time at £18 per hour plus my expenses.
 3. Notice of cancellation of contract
I hereby give notice of withdrawal from this alleged contract which was never properly offered or explained by you. The charge is not acknowledged, is not due and no 'service' from you was ever expressly requested by the driver or by me. Neither the driver nor myself gave 'prior express consent' or any consent at all for the alleged contract and it is not for me to reimburse you for foisting an unexpected and non-negotiated contract upon any driver of my vehicle. This 'contract' is hereby cancelled and any obligations now end. If you offer - and if I decide to use - your IAS or POPLA, then the contract still ends immediately on the date of their decision (whatever the outcome) so my notice of cancellation still applies.
As well as not meeting the requirements of the POFA 2012, it is my view that you have breached the Consumer Contracts (Information, Cancellation and Additional Payments) Regs 2013. In replying, you will also be acknowledging receipt and understanding of points 2 and 3 above. Where sent by post I have obtained proof of posting; where submitted online/by email it is deemed received by you unless proved otherwise. I look forward to your considered reply within 35 days."

 Any advice what's now?0

You missed the most important point - there can be no keeper liability at the airport, as there are byelaws.
This is why yo need to read the newbies thread. Again.0

Yes very important so get that in, also write to DVLA raise a complaint that they have issued your details under POFA where no keep liability exists.
await the rubber stamp reply then make a complaint to the ICA who will order them to send you £75 free money.
As no keeper liability exists, they should not have doled out your details as they are acting outside the scope of the act.I do Contracts, all day every day.0

Do nothing now - it's IAS so you won't win the appeal so stop and ignore it now. Which is what the newbies thread tells you = considered by some posters here to be a pointless and questionable (anonymous) kangaroo court. If it was POPLA we'd say appeal and win but not IAS, don't even give them the time of day:

Ignore the debt collector letters - please don't ask about those letters unless you get a Gladstones Solicitors letter.
We can't answer yet more queries about ignoring letters as we have said it all before and we can't add to the advice = IGNORE. There's a whole section of the NEWBIES thread about 'ignore the debt collector letters' stage.
JUST DO NOT IGNORE COURT PAPERS OR A LBCCC FROM A SOLICITOR.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
