Can I still use the NEWBIE template with a court appeal?

Hi,
I received a parking charge notice from Parkingeye LTD a couple of months ago and the time to appeal directly has expired. I have now received a 'Claim Form' from the court and have only 7 more days to respond before I receive a CCJ.
I am still able to appeal to the court but can I still use the template in the Newbie sticky thread?
Any help would be much appreaciated.
Thanks!

is it an ACTUAL court letter or what we call a Letter Before Court action ?
will have the words "may" or "can" in the latter LBCA, the real court letter would have details of the court where it would be heard etcEx forum ambassador

I suggest you download and study the Parking Prankster's guides to fighting a ParkingEye court claim:

The form just says 'Claim Form'. I spoke to the court yesterday, apparently you don't actually get a court summons for these cases any longer, so there won't be a hearing as such. The court just gives you 14 days to pay via a claim form, after this time you receive a CCJ that appears on your record.
Thanks for the links, i'll check them out!0 -
No - you refer to the LBCC Sticky - and the Prankster's Giude is also excellent.

Which 'court' did you speak with? Because they've either served you up some BS, or you've misunderstood them. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You have the option to pay, or to defend, on the claim form. If you opt to defend, there will be a hearing. It's not a summons, you only get those for criminal cases, this is a civil claim.
And you don't 'appeal', you have to write a defence, explaining why you aren't liable, either on the facts of the case, or points of law.
You have many, many hours of reading ahead of you to get up to speed on this.
