5.4 asks "Does the seller contribute to the cost of maintaining the building?".
In my extremely humble opinion, this may be open to interpretation. If she hasn't contributed to the building's maintenance, then it may be argued she has correctly ticked "No" and then should ignore 5.5 to 5.8.
"Does" is present tense and implies that the action has occurred in the past and is ongoing. It would be interesting to learn if the vendor was advised by her conveyancer when completing the form.
My suggestion would be to see if you could obtain half an hour of free legal advice. If this is not possible remember that "NWNF" lawyers aren't actually free.
If you take your vendor to court bear in mind the following :
1. It will cost you.
2. You may lose and have to pay her costs.
3. Even if judgement is in your favour, it may not be for the whole £3,700.
4. Even if judgement is in your favour she may not pay up, and it will cost you to chase the debt.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -
I took this to the end and it was settled out of court and I got all the money back. Yes it was worth the wait and the gamble.0

The real problems seems to be that when you next have a large council bill for repairs you are going to still struggle to pay it. Maybe you would be better off in a freehold property or a newer low rise flat.
Anyway well done on clawing back what you were owed. A lesson learned to anyone trying to deceive.0 -
The freeholder has their own pack of questions to answer for a buyer's solicitor and I am positive that this question is included.
Part of the reason that leaseholds take longer to purchase is waiting for freeholder's answers. I would be amazed if your solicitor hadn't sent those questions and/or the freeholder hadn't provided info.
If you are to rely on anything, it should be the freeholder's answers. Where are those answers?Everything that is supposed to be in heaven is already here on earth.
