Flight delay compensation - a better way?

I have been reading through this tread and wholly agree that long flight delays are unacceptable. I have also been looking at the effect of claiming on companies such as Monarch... which has been disastrous at best. I am not saying people shouldn't claim - if it was me I would!
I was just thinking that there must be a way that balances the needs of the consumer and the airline which doesn't end if financial collapse or pushing up fares. Perhaps a 50 minute grace period and then a charge per whole 10 minutes? A time limit to pay too. This would then allow a small amount of time to fix the issue and then provide more of an incentive to work quickly and resolve the matter without cancelling the flight.
