Christmas leave entitlement?

Hi,
At work we had our monthly team meeting earlier this week, during which, our manager told us he was going to be preparing the christmas rotas this week, which he did.
At the time we were also told that no one would be allowed to book holidays around christmas time and the only people who were guaranteed the 25th and 1st Jan off were himself, the deputy manager and the administrator.
The rotas were done this week. I have to work the 25th and 1st. We were told we would only have to work 1 of these each. And another member of staff doesnt have to work either of them.
Also someone has been granted A/L from the 24th to the 2nd.
Where do I stand with this? Is it unfair?

    Unfair - likely. Unlawful - unlikely.

    You could just ask your employer why you are on the rota for both the 25th and the 1st when you understood that you would only have to work one of them.

    Were you working last Xmas? Some places those who worked the previous Xmas get the following Xmas off which is right and fair.

    If the manager and deputy manager are not bothering to turn up on either day then how will they know whether you do? If that's the way they want to treat people another job sounds like a good plan to me.

    I think in most jobs a manager would know if an employee didn't bother turning into work.

    It was either intentional, and therefore nothing you can do about it, expect trying to understand why? Or it wasn't and you can discuss it with your boss. Maybe he is not very good at it and didn't realise that you were stuck with both days? Or maybe he didn't appreciate that you really care to have both off (some people, including me for a few years) are happy to work them and get extra money for it.

    Another question, you don't mention boxing day. Could it be that other staff are stuck with having to work two bank holidays, but they include boxing day?

    IIRC, you can't be forced to work a public holiday regardless of your contract.

    Afraid you are mistaken, their is no right to have public holidays off, although if you work them you are entitled to have a different day off.

    Not true - if it is specified in your contract that Bank Holiday working is part of your regular pattern of work then it isn't optional. You don't necessarily have to be paid extra either if the "premium" has previously been built into the payrate.

    As to the OP, suggest you ask the manager whether its possible to have one or the other off -but you may have to arrange a swap with another team member and also you might have to work Boxing Day instead?

    I worked in a bakery for a couple of years at the end of my career - the only Bank Holiday that the job shut down for ,was Xmas Day -you could be rostered for any other hours in the 364 days, with no extra payment.
