Advice on a PCN on a private carpark
splatmud
I have received a PCN from LCP Parking Services for £100.
I used a car park for 30 mins at one evening and didn't see any signs or barriers to suggest I should pay. In fact the car park was very dark with little lighting.
Their CCTV captured my car entering and leaving the car park.
I have ready many comments on this site suggesting I should ignore the request to pay.
Can anyone confirm that this is the correct course of action? If I ignore the notice will the charge increase and can I expect the bailiff any time soon?
I have full mitigating circumstances of course and am prepared to appeal.
Thanks.

Why not appeal now before it gets to the point of bailiffs?0

Ask again on the Parking Tickets board at:

Read the newbies FAQ first, there's a lot of good advice there.0 -
is this a new credit card?Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

As far as I am aware . Don't pay any private parking notice's they can harrass and threating debt collection etc but it will not affect your credit report and they cant enforce them either . Dont make any contact with them just ignore them
This is for Scotland . Elsewhere might be different . I have been told this by traffic police officers also that I work with regularly .0 -
This has nothing to do with credit cards - but - oh boy. Forget the mitigating circumstances for Gawd's sake!I have received a PCN from LCP Parking Services for £100.

You posted this new thread on the wrong forum, even though you also managed to post on another person's thread on this correct forum, earlier!
Read the Newbies thread from the parking forum (linked below as you appear to have got lost in the MSE forums!) or you are about to snatch defeat from the jaws of victory if you write a rubbish mitigating circs appeal when in fact you should appeal using our template. You are about to 'blow it' if you go and write something saying who was driving, blah blah mitigation...blah blah'. That would be a pointless appeal which throws away a winning POPLA appeal point.
But why on earth are you saying you have read to ignore this thing? Don't tell us, you Googled the subject then read yesterday's news, not even stopping to think 'hang on this thread I am reading is from 2012'. Why waste your time reading all those ancient threads from before the law about private parking changed, making clamping and towing away a criminal offence and setting up POPLA as an appeal for fake PCNs in England/Wales, an appeal that we parking forum members know how to win?
No, you don't ignore.
No you don't appeal with mitigating circumstances.

Wrong. Old advice if this OP is in England/Wales. And FYI, UKPC have started a few small claims in Scotland recently, not that they actually appeared at the hearing yesterday in Hamilton:Dont make any contact with them just ignore them

You surely don't actually think a private firm can 'send in the bailiffs' without the small matter of winning in court first? This isn't a real Council PCN.jonesMUFCforever wrote: »Why not appeal now before it gets to the point of bailiffs?
Anyway this OP needs to read the Newbies sticky thread from the 'parking tickets' forum:
http://forums.moneysavingexpert.com/forumdisplay.php?f=163
Sticky: **NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!
...and if in England/Wales, send the template appeal, as it reads as if he has the first letter (postal PCN). Splatmud you need to start a new thread there but please ONLY after reading the sticky thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
