You would most likely do better putting in a nice request for help with current financial hardship - forget the old historic charges, bank will just point to the 2009 court case and say the fees were fine. If you have problems paying bills now they might help by freezing fees, refunding some current ones etc.

Post on the debt-free wannabe forum if you haven't already, they can help you do a better budget to clear the debt
