Another accident - liability

  • Well as far as a 'chase' goes it's was probably the worst, most un-exciting chase ever, as I couldn't drive above 15/20mph without the back of my car trying to overtake the front. The steering wheel is so far out of line it's untrue and it's generally like driving in ice. Luckily being rush hour I had caught up in less than half a mile, unfortunately by then any witnesses had long gone

If they had tried to drive away I think the first thing you should have done is call the police. Driving away showed him to be a chancer and he will no doubt weave and duck. You need to be on top of your game OP. Write everything down from speed to road and weather conditions NOW before you start to forget, photograph the spot etc.
  • Thanks hintza. I have been back and took lots of photos of the scene etc, also have photos from the day of the accident of both of our cars. I've sent them all to the insurance. I'm just hoping the insurance company doesn't fall for his tall tale, time will tell
  • Your only problem maybe if the driver disputes everything. Yes from the description you would appear to blame free. What if he disputes location and vehicle positions?

Have you been back to look for cctv? At the scene and through the whole route until he stopped.

Maybe when you went back someone was walking their dog (same time every day), and said they saw it and offered their details to you in case you need an independent witness???

Have you reported him to the police for leaving the scene of an accident without stopping?
If an accident takes place, and either damage or personal injury is caused, then the driver of the vehicle at the time is required to stop at the scene of the accident and hand over their details and their insurance policy number a required. Failing to stop at the scene of an accident is an offence under Section 170 of the Road Traffic Act 1988.

Waste of time, that idiot will just lie his way out of it. The op has his details, how did he get them if he failed to stop?

Just saying, not that I agree with what he did. He'll just say he was looking for a safe place to stop.
