Hi,

I have received a letter today from a company called
"Buchanan Clark and Wells" Heres the letter:

Dear M*** T**********

We are trying to contact you with regards to a private matter. We have confirmed your address through a credit link obtained via a credit reference agency as being the same person who previously lived at the original address above.

Please contact by phone 08445714038 quoting the above reference number and one of our operatives will be available to take any relevant details to resolve the matter.

If you believe you are not our customer please contact us by phone 0844 etc to enable us to remove your address etc.

Yours faithfully.

David Smith

Please can someone guide me on what to do, I had a DRO put in place in 2009, phoned insolvency service 2010 & they said its now complete and I owe no debt to put it short. Today I received the above letter, I thought it was all cleared and now it seems to be starting again! Please help I'm really panicked over this.
My debts were on 2 credit cards, just under £15,000 I owed.

Kind regards in advance.

Typical soft trace letter. Quite possible you will hear no more.

No need to panic though, because if it is a debt covered by the DRO then you would just reply to any demands if they ever come with,

That is for bankruptcy, but it's exactly the same for a DRO. Just change the wording from bankruptcy to Debt Relief Order.

  • Thank you, I'll type up letter tomorrow and send it off to them, unless you think I should wait and see if I get another letter, they have correct details for me & my old address from 2008, just got worried as I've a newborn and don't need a bailiff knocking.

They are not bailiffs. No-one is going to turn up.

If me I would wait to see if they write again with actual details of what they are after. Up to you though.

    Hi there

If you are adamant that all of your debts were listed in your DRO application and that you have accumulated no further debts since, there is no cause for concern. As fermi says you can choose whether to respond at this stage or sit and wait for more info.

One small point - at the risk of sounding pedantic, DROs only came into existence from 9th April 2009 so your dates may be slightly wrong! It makes no difference to the advice given here, though.

EDIT - DROs started 6th April 2009. Thanks debt doctor :-)

  • I've managed to dig all of my paperwork out, it was 2009 that I started my DRO! Little confused on dates 2008 was when my card got cancelled, I'm positive that all debt were on there, I'm going to try ignoring the first letter maybe there'll go away with any luck.
I'll keep you up to date, thank you both.

  • Hi, received 2nd letter today saying details of debt, the debt was covered in my DRO! Should I now reply with the letter you recommend, basically there saying I owe this debt still and that there collecting on behalf of another company that I've not heard of aktiv kapital (client).
I'm still unsure how old debt is considered? There has been no account activitie since November 2008 but didn't put DRO in place till 2009 and this finished successfully in 2010, can someone please help me say if the debt is now statue barred?
Your all being so helpful to me, Im really grateful for all your advice.

If the debt was listed in your DRO paperwork, it is covered. No matter what.

If it is covered by the DRO then just send the letter.
