One question came to mind...If ive now cancelled the £300 deposit, which is what was expected in order to place the order, it technically means I haven't paid the deposit for them to start the work...so can the order not be void in this instance?
No. The point of a cheque is to be as good as cash. Although it has hopefully stopped the money going out, cancelling the cheque hasn't actually served any purpose from a legal point of view.
Indeed, if they did attempt to cash the cheque and it was refused, they could (but in reality won't) take you to court to recover the value of the cheque based on nothing more than "He gave me this, and it bounced", and they would almost certainly win. Any arguments relating to the contract would be a separate issue, and the court wouldn't be interested in hearing them.0 -

A response of "noted" is absolutely fine.
You can clearly show that this is in response to your cancellation email, so nothing further is needed, and all anything further will do is wind up the seller.
Expect your refund to be delayed as long as possible.0 -
Ok, thanks. "Noted" is such a flaky response so wasn't sure. Its like when people say "looks good to me". Very non-committal.
I guess my email was more making statements/notes of the conversation during the call so a lengthy response form him wasn;t required.
Either way, I've already sent the letter and will wait for their response.

Could have been worse, you could have paid it. At least you came to your senses. I've always just smiled and kept walking past those salesmen and women you see in the doorway of the DIY sheds. Don't think I'll even bother smiling now.0 -
Hi All,
Ok so the company phoned me on Friday to confirm they have received my letter, acknowledged it and requested I cancel the cheque as they have already submitted it.
They said they don't send out written responses :shocked:??? Anyway, the lady assured me they have cancelled the order and will not be proceeding.
Usually, I wouldn't trust them again, but I felt some honesty in her statements.
What do you guys think?
