Hi can you apply for pip again straight away after your Mr has been refused. I have breast cancer and was diagnosed with this when my Mr was taking place but they didn't even take it into consideration. I have sever depression and anxiety and this is what they turned me down on.I am in a esa support group and don't leave my home unless I have somebody with me at all times, up to me being diagnosed with breast cancer, I had been out 3 times in three years and that was only to visit asos medical. I am really struggling because I have to go out for treatment for my new condition.

Did you/are you appealing the decision based on your anxiety and depression?
As far as I am aware if you have a new condition then you should make a new claim for PIP.
However, I believe you must have had the new condition for 3 months and expect this to last for longer than 9 months.
Bit of a difficult one.
My suggestion would be to visit CAB (some have outreach support) or ask your Macmillan nurse about the best way to move forward.0 -
The reason they didn't look at your cancer diagnosis is because a new diagnosis can not be given as evidence for a MR, you have to start your claim again if you want this to be considered. Hi no I havnt gone to appeal, I thought it may waste more time it's took 15 months to get this far July 2013 is when I first applied got Mr last week. Could I use my depression for the 3months timescale and just put my breast cancer with it. Thanks for your replys.0

This is the part that I don't know the answer to.
If your breast cancer doesn't meet the required time period then , in theory, you need to appeal the original decision and then put in a new claim to cover the new condition. But am not sure what effect a new claim would have on the appeal.

Sept 2014, I have had the op and need cemo, herseptin radio and hormone for the next 5 years I filled the original pip forms in myself and because I never left the house didn't visit my gp or seek help for my deppression. But now I am on medication and will make sure I get someone to help me with the new forms. That is why I don't think going to appeal would help.0

I would urge you to get some help with appealing or starting a new claim.
Based on what you are saying then a new claim does seem sensible (but I am not an expert) if you had no evidence of your anxiety/depression at the time of your claim.
Certainly if you make a new claim then you could use your diagnosis and treatment for your cancer as a 'trigger' for the worsening condition of your depression and anxiety. In your evidence include the paperwork about your cancer and list the medication.
My only concern is the time factor of the worsening of your condition, now verified by your medication. (did the medication for your depression start more than 3 months ago?)

You need to go to CAB for advice on this one. The timescale of your cancer diagnosis may mean you have to wait 3 months at least to start a new claim. With PIP it's not about the condition it's how the condition affects you in daily life. However if you do decide to appeal the MR you have 28 days to ask for an appeal. Good luck.0

Sept 2014 when my husband made me go gp with new condition.0
