flight delay compensation

Hi,in september this year we were delayed by 5 hours on our flight time from Sanford to Newcastle, we arrived in Newcastle at 11.30am instead of our schedualed time of 6am, the plane itself was at Sanford on time, however when we got to the airport Thomson reps were there to tell us of our delay, when we finally took off the pilot told us that he got a phone call from Thomson on the day before our flight (sunday) when he was in Mexico to fly up to Florida to take us home, because he arrived at 3am on the monday morning his flying time was up and he could not fly untill 10.45 on the monday evening,this happened exactly the same the previous week, this to me is Thomsons fault for poor organisation, i have been in touch with Thomson when i got home and today 44 days later i recieved a letter from them saying i should clam through my insurance, do you think i have a case , if so what do i do from here Thanks
