Hello,
I hope to get some advice.
I sold a watch through eBay, an expensive item, £1450.Despite the price it sold within hours. I took a chance on a buyer with little feedback and he had sold no prior items just bought a few bits. He was asking questions and I answered. He said if I accepted his bid he would pay that night.
So in bullet points:
The watch is an Omega Speedmaster, two years old and just returned from Omega where it had a refurb and service and comes with a 24 month warranty.
He didn’t pay that first night he paid the following night after a reminder. He apologised for the delay, this is fine by me.
He wanted the watch next day before 9am. I was giving free postage and this would have cost me £30! I posted for 1pm next day delivery.
Upon receiving the watch he said he was very happy indeed but a few things needed rectifying.
He says one link is missing from the strap as is a pin and there is a scuff on the bezel.
When the watch returned from Omega I checked it and it was beautiful, no marks.
A link was included but I didn’t mention pins as the pin isused in the strap. As far as I know the strap is complete, I bought the watch new in store.
He said to rectify the problem he wants a refund of £45 forthe link and a polish for £20, total £65! It's not much money but its the principle.
Ive refused and this is what I sent to him.
Hello.
When Omega sent me the watch is was after their quality control inspection and it was returned to me in beautiful condition. When I sent them the watch there was no scuffs and when returned there were no scuffs. The day after I received the watch from Omega I placed it for sale.
I bought the watch from Beaverbrooks in Sheffield and I sat and waited while they took the link out and placed the link in the bag. The pin was reused to place back into the watch strap to connect the strap back together. This is why I believe that the watch strap is complete as it’s what I was given.
My advert doesn’t mention pins and I responded to you the following message 10th October;
“There is one large link included; I only had one taken out of the original bracelet”. I don’t mention pins or tubes in my advert or in the response. but I did clarify that there was only one link.
Everything that came with the watch when I bought it is included and some old spares. This is a second hand item and, although subjective, I regard the watch that you bought to be in excellent condition. What I would expect when buying anything second-hand are a few scuffs, I couldn’t see any on the watch I sold so I didn’t mention them.
I did invite people to view the watch prior to bidding and I wish you had but you live quite far away so I tried to describe the watch as best and as honestly as I could.
Regards,
If he claims for a partial refund through EBay would he win? I could ask him to return for a refund but in my mind it’s sold and as he said,he’s happy. After all it is a second hand watch.
I really, really don't like selling through Ebay.

No he cannot insist on a partial refund.
If he opens a case and escalates it to ebay they will insist on return for a full refund.0 -

You should really read Ebay terms and conditions before you sell on it. If you think you are in the right then stand your ground and refuse to refund.
Personally though I would ask them to return the item and once I have checked to make sure it was the same watch I sent them, block them and relist.
Ebay can take the money from your PayPal account or chase you for the money if they agree with the buyer it was not as described. They can't force you to partially refund though. The buyer might just be trying to get a discount. Refuse the partial refund and see what they say.0 -

If you sent the buyer a timex and said well in my opinion it's an omega do you think your no returns policy would stand up. Sellers who state no returns are usually a problem.
How have you described the item, can we see the link?
What if there is damage which was recorded when it was in for refurb, who would eBay believe then?0 -
What's paypals chargeback time?
Can't see such an item sold in the last 45 days.0 -

If the buyer files a snad case they will be told to return for a refund.
Tbh no returns means very little in ebay land.
Though it does sound like your buyer is just trying to get a bit more knocked off the price, if i were you i would just state return for a refund.DoctorFoster wrote: »What's paypals chargeback time?

Lol, Movember tash!
Ayway, so an Ebayer can claim upto 180 days after a sale? I don't like this buyer, I think he's dodgy but if my item is as described then there souldn't be any come back, I hope.
I hate selling on EBay, it can be stressful especially after the 15 emails he sent me before he bought the watch and the numerous after. I have good feedback and this chap could destroy it.
It's my daughters birthday today and as I tried to have a good time, this was playing on my mind, so I agreed to refund him £45 just to get rid of him.
I hope it has.0 -
Let's hope so and its not the start of further problems.
Hope he don't use the fact you refunded as an admission it's not as described.0
