Incorrect registration on windscreen PCN

Hi all,
I have read lots around this subject but looking for some advice and will try to make this as clear as possible - hope this is not too repetitive for some of you who really know your stuff!
ANPR left a 'Warning notice to driver' 'Parking charge notice' on the car. They ticked the box 'was parked in an area that should be kept clear at all times' and stated 'trespassed in an area known to us as...'
DATE on windscreen ticket - 12/08/2014 date on letter 13/08/2014 (!)
Not only that, they have written on the windscreen ticket the incorrect reg
[/B]
Today (62nd day after windscreen PCN and 44th working day after windscreen PCN) they have made their second contact via postal letter setting out county court summons charges that will be added should the fine not be paid now
Is this amount of days after a windscreen PCN acceptable?
In addition, there are the following discrepancies:
The date referred to on windscreen PCN is 12/08/2014
The date referred to on posted letter is 13/08/2014
The location on the windscreen ticket has a different spelling to the posted letter - by two letters but reads the same(hope that makes sense!)
Any/all help really appreciated! Thank you!

Have you read the Sticky thread for NEWBIES at the top of the main page that gives all the information on how to appeal and win?
The fact that the reg was wrong on the windscreen ticket or the discrepancy with the dates is irrelevant so you need to use the appeal templates in the above thread. This assumes this happened in England or Wales.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
Hi Sophia
What you have no doubt is a letter from Expedion with fake court letters. Expedion is run by Patrick Crossley who works at ANPR.
Whilst many of the PPC parking attendants attempts at literacy and writing skills need improving, they always take photographs of cars - which obviously has your correct vehicle registration number on it.
You should write a letter to both ANPR (joke company) and Expedion from the RK as an appeal - pointing out that they are too late to invoke keeper liability and include :
No contract was made with the driver due to inadequate signage.
No contract with the landowner / no locus to pursue parking charges aa creditor through the courts.
The parking charge amount does not reflect any GPEOL or loss to either ANPR or the landowner and is a punitive by default.
Make a formal complaint also to both the BPA and DVLA stating the RK is being pursued by this extension of ANPR.0 -
Hi there,
Thank you for taking the time to give me some advice.
The letter seems to be from ANPR ltd also so with no contact details to expedion so just send one letter to ANPR and not to DVLA/EXpedion and BPA?
how many days from the windscreen notice did this company have to send a letter in the post?
So from your advice, I understand its pointless to mention the incorrect reg and incorrect date on the windscreen notice in the letter to ANPR?
thanks again.0 -
Hi there,
Thank you for taking the time to give me some advice.

Everything is explained in the Sticky thread for NEWBIES at the top of the main parking ticket forum page.
You appeal to ANPR using the template letter in the NEWBIES thread. This will be rejected but you should be issued with a PoPLA code. You appeal again but to PoPLA this time using the How To Win at PoPLA section of the NEWBIES thread, and win. Only use the points in the sticky thread, wrong reg, dates, mitigation don't work so don't bother.I married my cousin. Don't worry about any empty threats from either ANPR Ltd (or possibly, eventually, Expedion) as neither will be going anywhere near a judge. Even if they did, the legal heavyweights both here on MSE and those on PePiPoo will be fighting with each other to join you in the first ever occasion that not-so-clever Trevor (Google Trevor Whitehouse for hours of mirth and merriment) ever steps across a county court doorstep in pursuit of a parking charge.
See the NEWBIES FAQ sticky and get your initial appeal off asap. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So from your advice, I understand its pointless to mention the incorrect reg and incorrect date on the windscreen notice in the letter to ANPR?
No:

Add it in to the usual appeal. Is this ANPR Ltd or ANPR PC?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

It is ANPR Ltd.
Thanks, the additional point about different dates/registrations will be included. Will come back with a template today.0 -
the following will be sent
a). The sum does not represent a genuine pre-estimate of loss, nor is it a core price term. It is an unrecoverable penalty and not commercially justified.
b). The signage is insufficient, the risk of a charge is not transparent and the wording is ambiguous.
c). There is no evidence that you have any proprietary interest in the land.
d). Your written 'notice' fails to comply with the POFA 2012.
e). There was no consideration nor acceptance flowing from both parties and any contract with myself, or the driver, is denied.
f). the registration number, dates and location on PCN and NTK do not match and therefore invalidates any case
g). Failure to meet the provisions of Schedule 4 of the Protection of Freedoms Act 2012, and as such you can no longer hold the Registered Keeper liable for any charge.
Can somebody confirm additional points f and g are correct to include in this way?
thanks again0 -
Be careful how you word things in respect of the windscreen PCN ... you have your RK golden ticket, don't throw it away by dobbing yourself in as the driver.
Edit: unless I'm missing something, d) and g) are the same thing?0 -
point g is included as the NTK has been sent over the 57 days it needs to be to be in compliance with The Act. Not sure if it is a repeat?0
