I have had esa money sanctioned for not attending work focus interview at job centre,I have had the money stopped off my esa since July and today I have been told the sanction has been lifted as my mental health prevents me from attending interviews,do I get the money backdated that was stopped off my esa the past 3 month?today I spoke to dwp business delivery centre staff as I am still got my money sanctioned today but was told that when they get paperwork from my advisor at jcp the sanctions will be lifted and backdated to when they started,I then phoned my local jc+ to be told that they will send the paperwork to bdc today, when I asked about backdated sanctions I was told no as no one gets sanctions backdated, what I want to know is do I get sanctions backdated or not?
Many thanks

If good cause has been given yes you will get arrears,

If the sanction has just been lifted without good cause then no you won't,

But if it has been lifted and you have never gone to the jobcentre since your missed appointment, then they must have allowed good cause, as it would not make sense otherwise.

My medical background was explained in full on phone today and lady stated she will lifted sanctions straight away and I won't hear about work focus interviews for at least 6 month,I think she also stated I would go up to higher rate (it was all a blur and to much to take in) but jc+ excepts my reasons for not attending interviews, just wasn't sure if I get the money that was stopped,I received £25 per week rather than £101,I didnt appeal today I just gave my medical background which they now agree I don't have to attend

If your mental health prevents you attending interviews then isn't a job seeker benefit counter productive

ESA isn't a job seeking benefit.

Your rate won't go up, the person you spoke to does not have the authority to put you in Support Group

What she meant was that you would go back to your old rate £101.

Expect the arrears to take about 2 weeks if you haven't had them by 2 weeks then phone ESA and ask. This does sound like Good Cause has been given, so you will get your arrears.

You are correct. But those in the Work Related Activity group are expected to attend WFI's which can be as frequent as fortnightly, and any work activity such as volunteer work, permitted work, job trials, courses etc as set by their advisor.

"Cannot get to any place outside the claimants home with which the claimant is familiar" is a WRAG 15 point descriptor.... exactly what Work Related Activity that claimant is expected to do is unclear to me. But I would have thought they would do WFI by telephone.

I don't disagree with you. Just pointing out normal requirements of someone on ESA WRAG.

Which while it is not a job seeking benefit it is a benefit that focuses on work related activity.

WRAG is very inconsistently applied added to which rules change all the time.
  • I have been in WRAG group and been to WFI's every 6 months. Not been forced to do anything. Just checking things and what I can do, such as volunteering etc when I am ready.
