Urgent advice needed! CPM rejected my appeal!

    Have you received the PPC evidence pack?
  • Nothing in my junk mail and I have not received the PPC evidence pack either. I will wait till next week before contacting POPLA

    Actually, if you haven't received the evidence pack I'd email POPLA now to enquire. Chances are the PPC haven't even sent one and you've won by default, but if they HAVE sent one then you not receiving it means you've missed the chance to rebut their evidence so a procedural impropriety has occurred.
  • I received a Formal Demand for payment from CPM today. I must say I am panicking now. Should I contact POPLA to find out what's up?

    Nope it will have been delayed due to no evidence pack, not their service issues. It's not POPLA's fault - relax and wait to win.

    To be fair, POPLA shouldn't delay review of an appeal just because the PPC hasn't sent an evidence pack. A motorist doesn't (usually) get a 2nd chance or leniency, so why should a PPC get one (from an "independent" appeals process)? ;)
  • The Appellant appealed against liability for the parking charge.
    The Assessor has considered the evidence of both parties and has determined that the appeal be

    [/FONT][/FONT]The Assessor’s reasons are as set out.
    The Operator should now cancel the parking charge notice forthwith.

    [/FONT][/FONT]It is the Appellant’s case that the parking charge notice was issued incorrectly.
    The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
    Accordingly I have no option but to allow the appeal.
