That is purely your view. I am sure that the company will be equally as sure that they are fully compliant, backed up by the expertise of their in-house and external legal teams. They simply chose to reimburse you in full as it was the most cost effective resolution.
I am glad that consumers have rights when making purchases online, but this was never intended to include an open-ended right to "try before you buy", which is effectively what you have sought.
Except that is precisely and exactly the right you have when you buy something online. You have an absolute right to try something before you buy it, to the extent that you would do in a shop (by testing a machine on display). And where you go beyond that level of testing, the retailer still has to refund you, less a deduction for damage where your use goes beyond that.
The company, after initially refusing me a refund, has not put up any argument against that and has refunded me. That is not to say that they will not try to refuse other people a refund - hence my advice to all and sundry not to take their No as a final answer - they quite simply do not have a legal right to do so.0 -
