I have found the handbook and am I correct in that it states as I am the person the insurance was intended for and as it does not state anywhere there that it does not include any mention of not accepting joint work?
Is this a complaint to the same people I spoke to from their office or am I meant to make an official complaint against the FOS?
Sorry just want to understand this correctly.Insider101 wrote: »I would get back on to FOS. Remind them of the definition in the FCA handbook of an "eligible complainant" which includes:
" the complainant is a person for whose benefit a contract of insurance was taken out or was intended to be taken out with or through the respondent;"
It does not say anything about the complaint needing to be made jointly between the two parties. If they make this statement then ask them for their authority. The above is yours, DISP 2.7.6(5) from the FCA handbook.
Tell them you are not asking for the full amount of the redress, you recognise it was a policy in joint names and you just want your share. Especially bearing in mind that the complaint has been upheld.
Can't guarantee it will work but worth a shot.0 -

Pretty well, yes. You are the person who was covered therefore you are an eligible complainant and they need to handle your complaint. I don't think you've answered the question about who the policy covered yet but if it was wholly or mainly you then it adds more weight to your case.
Making a complaint against FOS won't get you anywhere. There is a process by which you can do it, but only about the service you received. You can't raise a complant about the judgement of the adjudicator and this includes in matters of jurisdiction.0 -
Although I realise you do not know the whole case, please do not assume I want the money paid to me I have been solely paying into the debt left with many others by my x partner myself for over 8 years. I was told that it would be an idea to try and claim back ppi on this and other debts, which I have done to reduce the debt I have been left to deal with so when they company said that yes there was redress I asked for this to be added into the debt to wipe some of it out, to which I was then told oh we need your xpartners signature, obviously if the csa cannot get hold of him then it doesn't take a genius to know this would be impossible.
What I do not understand if I am the first on the ppi and even if they could not pay it all off why not half into the debt?? As it was a joint loan in the first palce, What legal rights do I have?
Hi kazzy
I was responding to user "Mirica" rather than you, coming out with the usual cliches about people who disagree working for the banks and not understanding how the payout process works, sorry if it read like it was at you.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
