Requesting Details of Default notice LLoyds

Hi, I followed a tutorial on learnmoney to try and remove 2 default notices (sorry I'm not allowed to provide a link but it looks something like this uuu.learnmoney.co.uk/credit-file/remove_default_notice.html

2 defaults logged by LLoyds (one current account and one credit card) which were probably logged years after the default occurred. I don't ever recall getting the default notice and believe that the time of when I probably defaulted was well over 6 years ago.

I sent them the first letter template asking for details of the default notice etc. and heard nothing back (I waited 2 months) I then followed up with the second template letter giving them 7 days to reply (waited over a month again ) and heard nothing back. I sent everything recorded signed for delivery.

Unfortunately the above link which I followed does say what action to take if you hear NOTHING back. What do I do now. I really want these 2 defaults removed.

Regards
Rob

  • They don't need to issue default notices for overdrafts. These can default quite late, but worth a complaint.

The card should have defaulted within 6 months.

I would give the FOS a call as its been 8 weeks since your complaint.

Might be worth sending a SAR to lloyds, as it will list account history such as when letters were sent etc.

Thanks for the reply. It was not for an overdraft. (well, it was a loan I took out in conjunction with my overdraft to pay it off)
The default was for a loan and the other was for a creditcard.
I did send a SAR and a reminder after a month. (template in the above link together with a postal order) but not heard anything.

So, a complaint to FOS it is then..
  • When did you send the SAR and reminder? They have 40 days.

    Hi Rob,

Very sorry to hear that you've not had a response to your requests. As you're understandably unhappy with this, if you haven't already done so, you may wish to submit your complaint to us. You can do that using our online form here. You can also find info on our complaints process on this page. One of my colleagues at Customer Services will then investigate and get back to you.

    Thanks,

  • thanks for your response but that would be a complete waste of time.
The reason I know this is is because I rang up today and was told they have no recollection of receiving anything even though it has been signed for and confirmed with then that the correct address was used! I also got fobbed of, saying that I may have had to channel the letter to the correct depart e.g. "Recoveries" within the Finance management unit even though my account is closed and fully satisfied...
I was also told they have limited resources and could only tell me when the account was open and closed??? The list is much longer but won't boor you or myself any more so taking it up with the FOS when I get my breath back.

they wont be removed and the fos will say its a true refelection of , ps the templates are out of date and have never been acurate
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

Why would the FOS say that? How can a default logged years after it actually occurred be a "true refection"? One gets a default notice before getting a default (kind of like a warning) This did not happen so didn't know anything about it, true reflection?

FOS can make some odd decisions sometimes, but in this case you may not be wasting your time as chanz thinks.
chanz nearly always trys to put people off. One of those people who thinks a bank doing something wrong is really the customers fault. smiley-rolleyes008.gif
