Landlord won't clear garden...

    Yes, a 'reasonable' LL would pay a 'reasonable' amount to compensate you for having improved the property of your own volition, but she clearly is not, and you can't make her.
    Your solicitor is ill informed-she is under no obligation to clear the garden unless it is a heath hazard, or unless the AST states that it would be cleared.
    I would be tempted to 'restore' the rubbish you have removed back again before you leave...

    I'm not asking for her to pay me for work done, but to remove her crap from my garden that I pay her for the use of.

    My tenancy states that I must 'maintain' the grounds. In order to 'maintain' the grounds, they would have to have been in a state which would allow me to do so.
    And then by the end of the week she'll be sending you your marching orders !! Are you happy to move in the near future.... got somewhere else lined up?

    If you like the house/area and want to stay there, bite the bullet and sort it yourself....... if not, move !!

    sad to say but not much you can do really apart from withholding some rent at the end and if she takes you to court argue your case there.

    Ifyoucan look for a better landlord, I have just moved from a LL that spend £0 money on her property over a lot of years, the place was falling apart, I've now gota HA place and it's in 100% better condition, wish I made the move earlier, renters get a bad name but LL are just as bad.

    Might not be easy tho with a pet.

    Ignore the posters saying you have anger issues, you have reason to, it's your home and you are paying good money to live there.

    Evict !!! No-one mentioned Eviction..... She can however give you your notice that she will NOT be renewing your Tenancy when your agreement runs out in 6 months time..... You will then have to move out..... So time to decide...... Bite the bullet and just clear the stuff out of the garden or start looking for a new house for 6 months time !!
  • It's not easy to find anywhere decent in this town/county. Infact, nowhere's 'decent' so settling for a neighbourhood watch area was my only option otherwise all other areas of this county are burglary and stabbing hotbeds. That's the reality I face.

    As for anger - yes, I'm fuming. She said she's clear it before I moved in - upon returning from Crete - she then returned from Crete and entirely went back on her word. Should I be delighted? Maybe I'll bake her a cake and thank her for doing that. Cheers, love. You've really made my day by leaving all your garbage in my garden. Awesome.

    The fact of the matter is that she said she would do it and now will not. A solicitor (who, may I add, is clearly much more qualified to advise than the poster here that's said the solicitor is wrong) has advised me that I have rights to issue court proceedings against her to shift her junk.

    I'm aware that some of you are probably landlords and will naturally take her side - and for that, I hope you never have a tenant like me. A Tenant that keeps the house spotless, repaints the front of the house for free (which she also said she wanted to do because it was peeling off and in a poor state), always pays rent on time, delivers her post to her parents if it's addressed to her, and basically knows how to be a bloody good tenant.

    Some of you have no empathy, really. And that's not my problem.

    To those giving advice that's actually worth something rather than being a senseless tit: thanks.

    It's a catch 22, sort of.

    The reason I moved in was for the garden she promised.

    She has gone back on that promise.

    So I like the house, but I liked my old house, too, I wanted the garden she was going to provide.

    So I like the house, not the lack of garden - I might as well have stayed where I was paying £400pcm rather than the £250pw I pay for this 2 bedroom house with 'landlord storage patch' out back that I also pay for.

    It's a !!!! take.

    There are literally no places to move. Have you ever been to Grimsby? It's not a nice place - but we both work here and have family here, so it's not a good option to move away. All I asked of the landlord was to come through on their promise and the entire reason for us paying so much rent in the first place - we would've never moved in if we knew she was !!!!!!!!ting about the garden.
