Just to let everyone know that the appeal and evidence have submitted, I take it they will let me know the decision by email or through post.

I will let everyone know the outcome.

    Thanks again for everyone's time.

Hi guys, The decision about my appeal will be on the 14th November, I have recieved an evidence pack from POPLA through email, is there anything I need to do?

    Thanks.

Yes. Read the evidence pack (which probably actually came from the PPC not POPLA) and rebut any points made by the PPC which are clearly wrong. (And there WILL be some, if not many).

Basically I've read through the pack and have noticed some things, they said my ticket wasn't visible or easy to read when it was the other way around but I have a picture they've sent me and shows the ticket number on the back quite visible, in addition to this they've sent me the estimate cost of loss of £124 even when I've paid for the ticket, there basically trying to defend everything I mentioned in my appeal. How do I rebut against these points?

New to this thread and can see it's been a challenge for some of the regulars.

In the very first draft appeal you posted you had a section on train operators. Can you let me know which location in Newcastle this is actually for?

I've just sent off a rebuttal of their evidence for the percy car park and I'll happily share the signage section of it with you if it's the from the same one.

In the meantime here's something you can use on the GPEOL......

"VCS have provided an attempt at a GPEOL document with a number of flaws:
The document shows their actual pre estimate of loss is £8.36 as all other items may or may not occur following the alledged 'breach'.
For some reason the document refers to the Independent Appeals Service and not POPLA?
If the document is to be believed then the actual pre estimate of loss for a £100 ticket is £124 which begs the question how do they remain in business?"

Check that your document does indeed refer to IAS.

Others may prefer a line by line rebuttal of the costs.

    Hi,

This is the east quay side car park I received the charge for. When you rebut do you just reply to their email they sent and just talk about certain points or does it have to be in some sort of layout template etc?

On the GPEOL document they referenced 'Independent Adjudication Service'

    Thanks for your help.

If it helps I could post their case summary on here and get some feedback from everyone, I only have a few days left until POPLA make a decision, what happens if I don't rebut? Does that mean I accept defeat etc?

I've skim read your appeal and personally I'd just let POPLA do their job, IMHO you've won. I've put less in many appeal and still won.

Given the feeling of 'panic' in your first numerous postings I'd say sending a rebuttal wouldn't be a wise thing. There is a chance I'll be in a minority of one though.
