I have looked briefly around but dont really see anything that helps me in my specific case.

Please tell us this is a joke??

The 'NEWBIES' thread at the top of the parking forum was written by Coupon-Mad specifically to help people with no experience of things like this to deal with these type of tickets.

If you are really too lazy to fully read up on it (which it seems you are if not prepared to follow the 'NEWBIES' thread through) you may as well pay the £45. There is an organisation who will deal with it for you for £16 but you may be too lazy to hunt them out as well, I dunno?

I'll give you a hint - this quote from Coupon_mad's post TO YOU gives you info you need:
You are in NI and if you just search the forum for 'Northern Ireland' and read the 'NEWBIES read these FAQs first' sticky thread near the top of this forum, you would know this is nothing. You could appeal as registered keeper (as explained in the NEWBIES thread) and see if they are daft enough to send you a POPLA code - or just ignore it! I hope your lengthy email did NOT actually give away who was driving - that would have been daft, but not insurmountable.

Just let us know if you get court papers - CEL never turn up even for hearings they arrange in their area, let alone a hearing in NI! All you'd need to do would be to get our help to submit a defence and then turn up to any hearing (local to you) and collect your costs from the Judge.

There is no need for you to get on like that.

Here is the information I read a while ago:
    If in Scotland/NI:

Apart from (of course!!) complaining to the landowner/retailer you should IGNORE your fake PCN unless you are not the registered keeper and that is a company (hire car or leased/company vehicle).* You are safe to ignore because there is no worthwhile appeals process - do not believe what the fake PCN says! This Watchdog video still applies in Scotland and NI because a PPC has to know who was driving (unlike in England/Wales now):
    http://www.youtube.com/watch?v=XAIcdi9niHA

WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY EVEN IF YOU HAVE MADE A PAPER AEROPLANE FROM THEM!

    ************************************************** **************

    * COMPANY, LEASE OR HIRE CARS ANYWHERE IN THE UK

In the case of a company car or hire car, the above advice differs. You would have to appeal EARLY to hook the PPC in your direction, before they get a chance to get the keeper's details from the DVLA or equivalent. You should also warn the owner/keeper (Fleet Manager) not to pay if they do get a letter about it because they have no business to get involved in a fake PCN you have already appealed as driver, and you won't reimburse them if they are daft enough to pay it.

If the hire/lease co has named you as the driver that is a good thing as it removes them from the loop entirely and then you can follow the above advice as appropriate to your case - but check and see if they have charged an admin fee. Challenge that admin fee with the Fleet Manager, Hire firm or your HR Manager, if your car use t&cs do not support this deduction for a mere invoice (as opposed to a fine/penalty).

There is no legislative info or factual based evidence to back this argument up.

Secondly, in my appeal I did admit that I was the driver.

Now I know you're having a laugh! Best pay that £45 before it goes up to £90 and shatters your credit rating for the rest of your life, eh?

I really don't see why you are being so arsey with me.
I have been reading for the last hour about popla decisions and numerous other threads, but I am just getting a sore head now.

I admitted I was the driver and they rejected the appeal.

If I appeal to POPLA and they reject it, then I am 90 quid down.

PLEASE READ. IT IS ALL THERE, CHAPTER AND VERSE , or shall we say, Legislation, applicable statute, Clauses, para.s, Case law., Appeal decisions etc.etc.!!!!
Bung this latest pretty in a forgettable folder with the rest of it.

I have been reading rather tirelessly and just want a simple answer, what I have read for NI is very basic info. The Youtube video is also somewhat outdated, as per the Youtube comments where people say they have since been given CCJ's against them.

As I have said I have acknowledged that I was the driver and the letter has been responded to.

Can someone please advise, without having a fit, what is the best course of action next?

How does POFA 2012 come into this exactly? And if I cant appeal to POPLA since i am in NI, who can I appeal to?

    That rider makes it difficult.

Zola, look at it this way. Send me £45 [otherwise £90]and I promise I won't write demanding money from you.

I have had a call from a local town councilor who has been challenging these guys for a while.

He said he has had over 40 cases and he's never heard of one that has went to court.

He stated they have a very weak legal ground to impose the fine and mentioned they'd need !!!!!! of losses obtained. Also mentioned the cival law contract and that its very weak.

Said he'd be extremely surprised if it ever went to court and his advice is to ignore the letters. Said if it ever went to court he'd be interested in being there with me.

However he did say that its impossible to rule out that they may one day seek a court action, however small, it is a possibility.

But all in all he reckons they never will.

I will file all the letters that I get, he says they will become increasingly threatening and I have to stick it out.
