Just thinking on this. If, heaven forbid, POPLA reject my appeal...and I then ignor all further correspondence and 'deny the debt'...could this in any way affect my credit rating? Or are the ONLY repercussions annoying letters?

    Thanks

Here's how your credit rating is affected:

    1. You go to court
    2. You lose your case
    3. The Judge awards costs against you
    4. You have 28 days to pay up
    5. You fail/forget/refuse to pay the costs awarded against you
    6. You receive CCJ
    7. Credit rating qualified
    8. Potential problems getting credit in future.

    Totally within your own control.

The one other potential might be if you move address and don't redirect post and 1. above kicks in without your knowledge.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

As Umkomaas says - nope. Letters from debt collectors can't damage your credit rating and there is no default against any credit agreement so there is nothing to record anywhere. Even if a PPC tries a small claim and wins at a County Court hearing (won't happen and you would know about it!!) then still there is NO CCJ if the losing person pays straight away:

    https://www.gov.uk/county-court-judgments-ccj-for-debt/overview

Records of judgments are kept for 6 years unless you pay the full amount within a month - this can make it hard to get credit.

Success! Only just though...the reason was that i didn't give away enough in my initial appeal (before I understood why the use of language was so vital) to idntify myself as driver! Backed up by a good appeal and rebuttal.

Thank you so much for all your help.

Is there anything I should do with the letter? Any way it needs to be logged on here to help other people?

Please post your succesful appeal on the POPLA Decisions Sticky thread at the top of the main page. Obviously redact anything that could identify you.

Please could you show the entire decision including the date, POPLA code and Assessor's name but minus your name and car reg, here and in 'POPLA Decisions' the sticky thread at the top, please?

We would find this useful to quote in future v PPS, as they just managed to win one when a rookie POPLA Assessor got hold of it.

Hi all and congratulations user 24601!

I'm a newbie I don't want to hijack this post and will not post again without starting a new thread but would appreciate some direction.

I have an identical situation to user 24601, same location, same PPC, didn't display my permit and also have prematurely sent an appeal, only difference is that I have miraculously managed not to identify myself as driver and they have responded inviting me to do so.

PPS are now IPC members so POPLA's not an option. Can I win like user 24601 or am I shafted and should just pay?

    Thank you

    Thank you

    neither

you are not under any obligation to pay, not unless a judge says so

neither are you under any obligation to name the driver, so dont unless you have a really valid reason to do so, despite what they ask, they can ask you to jump off blackpool tower, you dont have to do so (they have no authority whatsoever)

the PPC will refuse your KEEPER appeal but this should be done regardless, in order to show any court that you tried to resolve the matter and have started a paper trail

the IAS are likely to refuse your IAS appeal, hence why the NEWBIES sticky thread says not to bother

PPS have 6 years to try a court claim, which may happen (small claims court)

if you win, its game over

if 6 years elapses , its game over

if PPS win in court, you would likely have to pay around £175 to £225 in total , to avoiud a CCJ

no bailiffs can call without a court order, so not before you lost in court and even then only if you did not pay the judgment promptly (say within 28 days)

I hope that answers your questions, even if you are still not sure what to do

you could pay up , appeal, or ignore for 6 years, only dealing with an LBC or an MCOL, nothing else in the meantime

a landowner cancellation would nip it in the bud, so is your best option

just a shame you didnt look at the thread date though

you wouldnt look in a 2 year old tv times magazine to find out what is on tv tonight, as things will have changed, this thread is no different , times have moved on and with the PPC moving to the dark side and the Beavis case last november you really need to get up to speed on this topic
