Braking before speed camera registers speed and number plate

    Those cameras record continuous video and then the speed is taken instantaneously.


    Simply put, they will have seen you before you have seen them, hard braking is pointless.


    I agree with this, the vans are usually positioned in such a way that by the time you spot them it is to late and if you were braking the speed limit then you have a worrying wait to see if a ticket hits the mat

    No, you are not legally obliged to sign the form not in Scotland anyway. If I ever get one I won't be signing it and I will let it go to court and if I get six points instead of three then so be it.

    Okay it's different in England and Wales so to say it's a bad idea in general is rubbish, it's a bad idea in England and Wales.

    Simple Google search of recent cases in scotland is all you need to see for yourself
  • I think basically (in England at least) there is no loophole, no mitigation, no real way to get off a fine. It seems it just easier to pay up and take it as lesson learned, forget about it and get on with your life. Its never worth the stress trying to fight it imho. Please tell me if I'm wrong.

    You probably are obliged to sign it in Scotland. The fact that so far the matter hasn't been decided in a court of record doesn't mean that the obligation does not exist - it just means that it's not possible to say for certain whether or not it exists. Case law doesn't change the law or create new obligations - it just clarifies existing ones.

    The likelihood is that if push came to shove the Scottish courts would follow the English ones on the matter. Thus far there has been a lot of push but not much shove on the part of the Procurator Fiscal, but there's no guarantee that they won't bring some test cases in the future. If they do, it's likely that a lot of people who thought they were exploiting an easy loophole will end up with six points. If you're willing to take that risk then fair enough, but it would be wrong to suggest that the risk does not exist.

    If you're in Scotland, don't imagine failing to sign will make it go away. It's likely you'll have the police calling at your home (and/or work) for the next six months.

    If that's the case then please can you put that info in the first part of that specific post.

    Stating it another page on means it is highly likely to get missed.
    Remember the saying: if it looks too good to be true it almost certainly is.
  • If you are in any doubt about whether you can get away with a speeding offence, then take a look at the sorry tales over at Pepipoo and the large number of ways people manage to get 6 points and a large fine from what could have been a speed awareness course.

    There are lots of things on the Internet suggesting all sorts of things you can do, but the legislation around naming the driver is pretty rock solid because it was specifically introduced to stop all the games.

    In Scotland, you don't have to name the driver, but instead you will get the police coming around to interview you and you may well feel that playing silly b's simply backfires in that case.
