Misco - accidental wrong price and all orders cancelled

    I believe most, if not all, major online retailers now say that the contract is not concluded until the item is despatched.

    I was hoping to buy this cheap tablet for a friend - long story, unusual situation - I thought it was cheap but given that it was opened box, old-ish technology and low spec I assumed this Misco outfit was box shifting a purchasing mistake by them. Consolidators do get pallet loads of these that have been returned to catalogues or home shopping channels.

    btw. I now see that Misco (never used or looked that them before) sell open box, older/dated, low spec tabs at quite high prices considering - I would do better getting a brand new up to date generic Android tab off eBay. I did that for a colleague a few months back and so far its been fine. Ie. new tab, supposedly with a 1 year full warranty.

Funny that, as with another box shifter web site I found it impossible to cancel an order I had made in error despite the fact it had not been sent out yet.

    So they can just cancel all the orders and refund the money. That's what they say they will be doing.

    But they will have taken or earmarked the money on the credit card so they can take it if they want.

    Its time this sort of thing got tested in court.

    They can cancel until they post out if that's what their terms say, you can cancel up until 14 days after you've received, provided it's not been used (with some exclusions irrelevant to this situation).

    No need to go to court, the rules are quite clear, and are in favour of the customer as you have longer to cancel the order than the retailer.

    Whoever refused your cancellation was wrong, you should take them to court as they're the ones not playing by the rules.
