The village hotel

HI
I really need advice.....I booked and paid for a hotel room at a bargain price and had a confirmation email. Now I've had an email a week later saying it wad an error should be £90 more if I want to pay thr extra they will honour the booking!!! What are my legal rights??? I'm so angry booked this room as part of a friends birthday treat so made a big thing about writing an itinerary for her special day...now not sure I can find the extra money!!!

    i have had the same email and in the same dilemma. i received booking confirmation at the lower rate and the money was taken from my card at the time.

    unfortunately reading through the T's & C's they quote "In rare cases, we may have to cancel or reject a booking due to “obvious errors.” For clarity, an obvious error is a mistake on the website (e.g. in terms of price) which a reasonable person would not consider to be normal"

    So based on that i am not holding out much hope :-(

    Mistakes can be allowed for in law, the contract is concluded on acceptance, this is not just by an automated response and taking your money by computer.


    This is just classed as your offer, when someone human looks at that offer they can then decide to accept or reject the offer, in this case your offer was rejected and perfectly legal to do so.

    You could try contacting the hotel and explaining that you would not have made the booking at the full price, but had made plans around that date. Ask if they could reach an acceptable compromise.

    Also file a complaint with the company that took your booking, and point out that they should not be advertising rooms at unavailable rates.
    Some days, it's just not worth chewing through the leather straps....

    What was the price you paid compared with the price they want?

    Their T&Cs say they can cancel for an obvious error, where "an obvious error is a mistake on the website (e.g. in terms of price) which a reasonable person would not consider to be normal." Was that the case?
  • The price was £9 we had to put the promotion code in that they gave us when booking the function. I think its disgusting that they can do that, I wonder how many people wouldnt have booked the christmas fuction.

    Was the £9 room rate specifically advertised as part of a promotional rate if attending the Christmas function? If it wasn't then it's hardly surprising that the hotel has cancelled the booking.

    If a hotel cancels a booking then there is potential for taking action against them for any extra costs incurred, but these would usually be incidents which happened at very short-notice where the consumer wasn't able to make new arrangements.
  • Yes it was a promotion...had to entre the code xms when booking was given this code when i booked a christmas party night.

    This needs to be a little clearer, did the hotel specifically mention that the rooms were reduced to a special rate in conjunction with a booking for the party night? The promotional code is likely to be irrelevant, this could be a mistake. In essence, did the hotel mean to sell these rooms at any stage for £9?
