Buymobiles cash redemption

Hi All,


I am having a torrid time with Buymobiles.net and claiming my cashback.


In order to redeem cashback you have to submit bills and a voucher. I duly do this by recorded delivery but when I claimed my 4th redemption buymobiles never paid. After several emails and calls I convinced them that my voucher was signed for by a named person in their office. They admitted they knew the person and could see on the Royal Mail website that a delivery from me was signed for. The cashback was paid after much persuasion by me, albeit 3 months late.


Unfortunately, the timing of the cashback coincided with my voucher 5 claim. After I submitted my bills and voucher 5 I received a confirmation email from buymobiles that they had received them and I would receive payment by BACS 60 days later.


90+ days have passed and still no payment. I have emailed them 11 times and their customer service department (1 lady called Debbie) constantly says the email was a mistake and I had been paid. After advising them that they have paid voucher 4 but not voucher 5 plus advising them that I have 5 confirmation emails but my bank account only shows 4 payments, they still refuse. I have asked them to check their records to do the same totting up but they refuse.


It's now got to the point where they are just been difficult and refuse to pay my voucher 5 cashback. despite me following their rules to the letter.


I am now £18.50 short which I agree is not a great deal of money but If they were owed it they would surely be threatening me.


My dilemma now is how can I enforce them to pay without it costing me money. I have looked at Money Claims On Line (MCOL) and that's £99.


Is it just a case of 'put it down to experience' or should I fight my principles?

    It was only £25 for claim up to £300 ...has something changed ?


    You could send a LBA, you would need to do that before you put the claim in anyway

    Your right about the £25 but I'm sure I read that with extra court fees it would be £99. What's a LBA, that may be worth looking in to.

    Letter Before Action ...saying if they don't respond within x days you will take court action

    I sent them an email giving them 7 days to respond otherwise I would take legal action. They did respond with "payment was made on......". They are ignoring the fact that they have confused voucher 4 payment with payment 5 voucher and will not check their records.


    The idle threat has now back fired so the ball is in my court. Is MCOL the only route I can take?

    MCOL is the cheapest option, what do you plan spending the fees on to get to £99?

    Er... they should have (in the instance you gave) 7 days for you to receive payment.

    Set out the facts in the particulars of claim (limited text so beware) and spend the £25.

    It's not up to you to chase their admin systems with them. Royal Mail said delivered, they didn't accept or pay - send the LBA and then sue.

    The next claim is a separate issue, with a separate acceptance (or otherwise) and a separate legal claim.

    Your facts are incorrect - they never say "60 days", though their website says one thing and the email/text acceptances do vary. I have sued them several times this year and they have gone the extra mile with me (and then some). Soome of the people I watch over have also taken that route.

    The £99 relates to enforcement, but I've never needed to go that far. You get the court fees back when you win as long as they are still trading.

    I have used them several times over a few years and always get paid - one way or another. You should know from day 1 on any cashback deal exactly how the game is played and what to do if there's a foul. I do have a degree of sympathy with them; I believe much of this is to do with some of the networks (as with Phones4u where you would have lost ALL unpaid cashback) rather than their own motivation or actions.

    After threatening Buymobilephones.net with an LBA I received my cashback. Just submitted by 6th and final voucher by recorded delivery so I'm prepared for battle this time.


    I also received a call from them asking me to upgrade with them....AS IF!!!
