Was this a joint tenancy between all 5 students or did each student have an individual tenancy agreement with the LL?
The LL may well be trying it on but without any evidence it will be difficult for him to justify the deductions. Stop texting the LL. Presumable you, your son, or the lead tenant if this was a joint tenancy, has raised a dispute with DPS. The LL has not backed down so whoever raised the dispute takes it to arbitration with DPS and the arbitrator's word is final.0 -

:mad:DPS is owned by an investment company, the amount of money they are holding from deposits is collosal. We had no say in the matter, as all landlords are now required to place tenants deposits in schemes.
No-one is forcing you to use the DPS custodial scheme. If you want to hold the deposit money yourself, use an insurance-backed scheme.
Presumably the money made from interest on the deposits in the custodial scheme helps to pay for it - after all, DPS has running costs to cover.Let's settle this like gentlemen: armed with heavy sticks

I'm not sure if this is the case in reality as securing a student house in my experience is pretty competitive and if you asked LL/LA to use something other than DPS they would simply choose another batch of students to rent the house?0 -

We have raised a dispute with DPS. But at present we only have text contact from the LL . I hope whatever the LL sends to DPS we have sight of, as we've nothing factual in writing to go at the moment.

Were you named on DPS paperwork, or is deposit in the name of your son? If son I think only he can pursue matters (unless he grants you the equivalent of a "Authority to act on his behalf" which DPS are happy with)..... Any reason why the tenant has not written (yes, WRITE! - keep copy) an LBA - letter before action - to the landlord at the address in the tenancy agreement "for the service of notices"??.... But at present we only have text contact from the LL .... ....0 -

I was responding to the OP's post with their "landlord" hat on, saying that they had no choice but to use the scheme. The tenant has no say in which scheme is used to protect the deposit, and it shouldn't really matter to them anyway.Let's settle this like gentlemen: armed with heavy sticks
