t_mobile cancel ignored because of unused pak number

I cancelled my contract with tmobile giving 30 days notice.
They asked if I wanted to keep my number, I said yes and they gave me a pak number. They told me I had to use it within 30 days or it would expire, they never said that I had too use it.

I later decided not to use the pak number, but then found out I had a bill for the following month.

When I called them, a very rude, argumentative man told me "It was because if you don't use the pak number the account stays open, and if I want to cancel I would need to give another month notice. They sent me a text to confirm and if I didn't read the small print then it was my problem not theirs."

I checked and I did get a text but I had assumed it was just confirmation of the pak number as agreed on the phone. It never occurred to me that this would prevent the cancellation

Can they do this.??

    Yes, the PAC overrides your cancelation notice although you should have been told this at the time.

  • I think where people have taken this issue up with regulators, contract law overrides terms and conditions.
    Start the complaints procedure and then go to the regulator.

    Waste of time if the OP was given an explanation in the confirmation but chose not to read it.

  • It is a bit more complex than that.
    What the actual contract formed at time of opening says about cancellation is what is important.
    They can not amend a contract with a text message.
    Well they can, they can do as they like and often do, the question of what is lawful or legal is another matter.

  • Alternatively they could of cancelled the contract and you would of lost your number which you would be fuming about.

    You either cancel and lose your number or get a pac code which cancels your contract as soon as it is used

    To add insult to injury, the tariff change from 10 to 25 pounds because of discounts on the original tariff. Although to buy a similar plan from them now costs only 12.99 ( sim only)
  • Start by requesting a copy of the contract that was in force at the time you made the contract, make sure they do not pull a fast one with a later contract.
    See what this says with regards to cancellations.

    Law always overrides policy when it comes to the crunch.

    You didn't just cancel you ASKED for a pac code, in order for these to work the number has to be active until you transfered your number.

    This is in place so people don't accidentally lose there phone number.

    I know that now.

    Before it never even occurred to me.
    I think they could have told me when I called, they told me the pac number expired after 30 days but not that the contract would continue.

    I won't make this mistake again but I'm sure I'll make different ones.
