I find it interesting that some of the EAs posting on it here seem to think its all the buyers fault for agreeing to pay the extra. Does anyone agree with me that it seems illegal, unfair, unjust and that there should be some kind of legislation against it? The whole process needs increased regulation and transparency in my opinion.0

Im not sure I follow
What do you think is unjust ?
the fact that you cant check on other buyers and what they have offered? I personally wish there were more transparency, but under the DPA I really dont know how thier could be without dumping the act adn starting again.
Illegal
Only illegal if it contravenes a law, at this stage, rightly or werongly, no law that I am aware of has been broken, if anything your frustration is arising because laws have been followed ( data protction act)
unfair?
i cant see anything unfair here, you have chosen to act in a certain way and the great thing is about the english system ( as opposed to the scottish or australisn etc) is that you can back out. You CAN change your offer.
Why dont you do that and reduce your offer? You seem so angry about it- why dont you call tyhe EA and say, no im not paying more, I actally cant/ wont stretch to that? Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
Theres no dollar sign on piece of mind
This Ive come to know...
So if you agree have a drink with me, raise your glasses for a toast :beer:0 -
EAs know that the game is up.
That is why we are hearing them come out with all this bleeding heart, I'm a hard done by pillar of the community rubbish while looking around for people to blame and secretly wishing that HPI would continue forever and ever.
The best is yet to come though. watch them when the market really turns negative. They'll be sh1tting themselves.
The same happened at the end of the last boom.
EAs are up there with traffic wardens and tax collectors as national
hate-figures. And they are there for a reason.
The reason is that most of them are lying, thieving !!!!!!!s.0 -

I think this discussion is really interesting
So - Lynzpower- with your experience, what would you have done in my situation.
Bear in mind I really wanted the house, but wanted to save some money?
How would you have approached it differently?
What negotiating tactics would you have used?0 -
I can understand peoples violent reactions to estate agents generally... I have also been a victim of un honorable practises (between the agents and vendors!) BUT it's part of the game until the game changes you take your chances. The problem is we do get too emotive over buying a house and if more of us refused to play the game - walk away when things smelt a bit iffy then agents wouldnt get away with some of the manipulations that they do get away with. I guess at times it also depends on circumstances too:j Where there is a will there is a way - there is a way and I will find it :j0
-
ie you really do have to move IMMEDIATELY but generally for most of us - moving isnt life or death - just an overwhelming desire - which some agents do play on.:j Where there is a will there is a way - there is a way and I will find it :j0

It is illegal under the Estate Agents Act 1979 to make misleading statements such as inventing or inflating bids or inventing another interested party. The problem is proving it, and estate agents know that.0 -
So can anyone think of a way in which it could be proven?0
