National Insurance Contributions whilst claiming benefits question

My husband is claiming PIP, (was also claiming ESA)
I am claiming IS and CA
we have 2 children under 10
I phone ESA today to close the claim as i (as from today) am claiming IS.
The advisor said that my husband would no longer get NIC unless he goes from IB ESA to CB ESA. One of the reasons i have stopped ESA is because of the stress of the medicals for him to go through.
Now i am wondering how i go about him still getting his NIC (he is 37) and has approx 20 years NIC?
Is the only option to pay voluntary unless he stays on CB ESA?

You will be getting class 3 NI credits through your child benefit (presuming it is in your name) until a child is 12 years old. Class 3 credits goes towards state pension and bereavement benefits.
Class 3 NI credits are also paid if you are receiving CA.
So, if I am reading this http://www.hmrc.gov.uk/ni/intro/credits.htm
correctly you either swap the CA claim to your OH's name or put the Child Benefit claim in his name so that you both get your NI credits paid.0 -

Having done a bit more reading about it I am now totally confused!
Read that your OH would already be receiving the credits. Also read that as you are receiving CA you will be getting class 1 credits!
So suggest you give them a ring to see what you should do.

Just one last thing.
Class 3 NI credits go towards state pension and some bereavement benefits but do not entitle you to contribution based JSA or ESA.
Class 1 NI credits do count towards contribution based JSA or ESA.
So, if CA gives you class 1 NI credits then you might need to think about who is likely/possibly to need these in the future.

Thank you - i have just phoned. I can change Child Benefit into my husbands name (for some reason i am reserved to do this, but think this must be the only way other than paying)
I unfortunately didn't ask about class 1 or 3 as didn't see your message before then. aghhhhhh i'm still kind of confused. but not, i think its just making that decision.
1 thing is telling me that its silly to pay £13.90 per week if just swapping the claim from my name to his name on CB is the answer?0 -

But if the OP is receiving the CA for her husband, then there is no option to choose who receives the CA.

Yes, of course.
Was thinking she was receiving it for a child but your scenario makes perfect sense.
So, changing the CB is the way to go. That makes it simpler for OP

i'm now confusing myself further with regards to class 1 / class 3
what am i /will my husband be receiving for CB?
and me for CA?
