    Hi pinkprincess09,

Thanks for making me aware of this.

So I can get things looked into further for your husband, ask him to email me with his details via the link in our profile here.

All he'll need to do is copy and paste the link into his web browser and it'll take him to the Contact us form on our website. To make sure it reaches me, he'll also need quote the code WRT135 - MSE in the subject line.

Once sent, he'll receive an automated reply with a reference number. Post back with this and I’ll check I've received it.

    Kind regards,

    Lee

These debt collection companies operate at the very fringes of the law and they are normally more than happy to cross that line. Firstly they are taking the p**** since they know that the debt they are chasing cant be enforced anyway. Secondly they may have just picked his name out of the phone book. There is a post on here somewhere were the poster found that the debt collection company couldnt find the original debtor at the provided address (they moved) so they just picked the first identical name from the phone book and chased that person.

If your husbands credit file is clean (and after this time it probably will be) then i wouldnt even bother sending them a prove it letter. I would just send them a letter telling them you are reporting them to the regulator (it should say on the letter they sent who the regulator is) and tell them if they contact you again you will treat it as harassment and get an injunction against them.

Well, firstly all main CRAs have to be checked, not just one.
Secondly, the files don't show anything older than 6 years and don't prove anything if the debt is older.
Hence, at this stage I don't see anything real to complain about. If the debt exists they can keep chasing you even if they can't enforce it.

All true but it depends on how much you are willing to put up with really. They are clearly chancing their arm on this as they are without doubt not going to be able to prove any debt ever existed. Also they never send polite letters so in all probability they are sending bullying/threatening letters for a debt that even if it did exist is not legally enforceable.

You are 100% correct that they can and will keep chasing UNLESS something is done to stop them. That is why i would send a letter now basically telling them they have no chance and that i would be seeking an injunction if they contacted me again. Many people do seek and get injunctions against debt collectors (even those chasing valid debts if you can prove harassment). Also i would imagine that it is against the code of conduct to pursue a debt that cannot be enforced as in that case there really is nothing they can do other than harass you into paying.

Perhaps you are not like your username :)
I on the other hand get really angry with companies that try it on (even slightly) so for me the small bother of sending them a nasty letter telling them i know exactly where i stand and to **** off would be more than worth it.
