My tenancy states the following.
to allow persons authorised by landlord access to property for purpose of attending to garden
not to lop, cut down, prune or remove or otherwise injure any trees shrubs or plants growing upon the premises
That reads clear enough, the hedge isn't your responsibility.
Have you looked in the landlord's responsibilities section of the tenancy agreement, does that say he will do the hedge? If not then it looks to me that no one is obliged to do it.I enquired as to the clause stating that I am not to cut bushes trees etc, apparently this doesn't apply when the landlord gives permission. My contract does not say this, and with the amount of times they've quoted the contract to me negating common sense, sirely this does not apply?
I do not think the landlord giving you verbal permission to cut the hedge makes any difference unless you agreed that you would as part of the conversation. If you are happy to leave it uncut then I'd be writing back explaining that you never agreed to cut it and citing the tenancy agreement and that you won't be cutting it. I'd do that just to put it on record to head off any claims from your deposit when you leave. By write I mean on paper to the address for serving of notices. It'll repeat what's been said already but the idea is to put it on the record.0
