Definitely keep replying to try to get this cancelled and so your case isn't just churned through to court like they do with a batch every week. Make yours different and robustly argued, continuously every week if need be, a bit of email tennis might do it! Use their email addy to save stamps, and keep up a dialogue until they get fed up with hearing from you and cancel it (maybe)!

Send a copy of the Blue badge (again if you already have done) and tell them to check the Service Provider's section of the Equality Act 2010 Code of Practice:

    http://www.equalityhumanrights.com/sites/default/files/publication_pdf/servicescode.pdf

...because a provision such as a disabled bay is for disabled people (not just those with a Blue Badge on display at one point in time) and you have proved that the passenger has a Blue badge. So to continue to harass you over this parking event is a breach of the Equality Act. To insist on a Blue badge being shown, when some disabled people don't even have one but could still need such a bay legitimately due to their condition, is creating a barrier for the disabled person who is now being treated detrimentally. The disability need to use that bay doesn't suddenly disappear if the display of the Blue Badge is forgotten (forgetfulness, after all, can be a feature of many disabling conditions in its own right and a firm cannot profit from something relating to a disability). The bottom line is, the passenger was entitled to have the use of that bay in law and you have shown them she was entitled. And there was no loss caused to the landowner and no bay was taken up by a person not so entitled. As such, you expect this to be cancelled and have complained to the Retailer's CEO in writing now about this bullying culture from their agent.

(have you complained yet?). To the CEO?

  • I have not sent them a copy of the blue badge as they haven't told me what the PCN was for (I remember getting it for parking and not displaying it)
I have not contacted the retailer yet.

I would do both - say the occupant of the car has told you they recall the situation and so...blah blah about the Equality Act/attach copy of BB.

And complain, definitely, to the retailer. There is no need to hide - this is harassment of a disabled person.
