Help regarding P EYE

On 16th March 2013 I received a PCN from Parking Eye (for parking in a disabled bay and not displaying a blue badge an oversight) rightly or wrongly I chose to ignore it.


I believed I had "got away with it".


The parking was on a retail park which is free.


This weekend I received more communication from them dated 15th September 2014 asking for £70 to be paid within 14 days.


The letter talks about Schedule 4 PFA and 29 days having passed, am I right to just ignore this letter or is there something I should be doing?


Can they still chase me 18 months down the line?.

    Yes they can. Name the driver who was someone else - that resets the clock in postal PCN cases. I am sure you will recall who was at the wheel that day if you think hard about it - name and address. Template letter for that is in the Newbies thread and it means instead of facing court, the case can be won at POPLA once the driver gets their PCN.

    Even if the driver now lives abroad that is not a problem. As long as the address is serviceable, i.e. can receive letters, they must accept it, although they may try to tell you otherwise.
    You never know how far you can go until you go too far.

    ParkingEye, disabled bay and blue badge monitoring, not the usual MO. I know they do have boots on the ground in a small number of places.

    As sometimes OPs use 'Parking Eye' as a generic term for a PPC, it might be helpful if the OP could confirm that this is, in fact, ParkingEye.

    I did suggest naming the driver earlier but - I take that back if, from what you said in post #1, this was a windscreen ticket from PE (very rare) and NOT one to name the driver about. The driver should have appealed at the time if they got a windscreen PCN in that disabled bay. Resetting the clock only works for a postal PCN where the driver has never seen it/had their chance to appeal yet.

    Was the person disabled and just forgot the badge?

    What happened when you complained like mad to the CEO of the retailer, as you would about this intimidation?

    The disabled person was with me we just forgot to put the badge out. I have not complained to anyone I just threw the PCN in the bin and thought no more of it 18 months later Parking eye send a demand for £70 as I said in my opening post.
    Today I have done an online appeal and asked for further details from PE informing them that parking is free in the retail park.
    Am I fighting a loosing battle?

    No you should be complaining about discrimination and harassment of a disabled person, to the CEO of the retailer, urgently. Blue Badges don't have any clout AT ALL on private land and the bay is there to be used by disabled people (badge or not) under the Equality Act 2010. This harassment by their agent is illegal.

  • I have a response yesterday from PE stating they are fully compliant with the British Parking Association regs on signage, confirming adequate signage which is visible, appropriately located, clear and legible so the PCN is fully enforceable.


    The PCN has been placed on hold for 14 days to allow me to provide additional/further evidence.


    Quote:

    I did ask them for further details regarding the PCN they have not provided anything except this letter.


    Should I still pursue this line by asking them to prove which terms and conditions I have broken?
