WARNING: NOTICE OF IMPENDING LEGAL ACTION – DO NOT IGNORE

09 July 2007

Dear Sir/Madam,

Mobile No. XXXXXXXXX
Cashback No.XXXX
Overdue cashback claim: £XX.00

I refer to the above overdue cashback claim and note that it has remained outstanding after such a long period. Despite previous email to Ms XX at mobileshop.com on XXXXXXX and a series of email enquiries on XXXXXXXXXXXXX and XXXX we sent out regarding the overdue cashback, the money still has not been paid to our bank account.

According to paragraph 6 of your Cash Back & Reduced Line Rental Terms & Conditions, all cash back payments will be paid within 60 days of the valid claim date. You received my valid cashback claim (part C) on 16 Jan 2007 which was due to be paid on 15th March 2007 and the claim (part D) on 13 Apr, due on 12 June. It is now 115 days (for Part C) and 26 days (for Part D) overdue respectively, and it appears to me that payment is still not forthcoming.

You are therefore acting seriously in breach of the above mentioned terms and conditions. I now regret to have to formally write to you (by both post and email) and inform you that should I not receive the full value of this outstanding debt in my bank account within the next SEVEN days, the legal proceedings will be instigated against you without further notice to you. This will result in you having to pay statutory interest on the debt from the above due dates and the additional legal costs of debt collectors sent to your company to seize the assets to cover all outstanding amounts once a judgment has been obtained.

I suggest that you obtain legal advice in this matter or settle this outstanding debt immediately and I look forward to hearing from you within the next 7 days.

Yours faithfully,

XXXX
