tesco - cancellation charge?

i signed up with tesco bb and phone,
phone was ok , but problems with bb as in i could hardly ever get a connection.
after contacting their technical dept who could not resolve problems, i was advised by them to change providers and that the early termination fee would be waiaved.
i changed to bt and they charged the e.t. fee to my account, despite many emails they are refusing to refund the fee.
any ideas as to what i can do

Do you have any documentary proof that they offered to waive the ETC? If not you'll have problems getting anything. If you do then tell them in writing you'll be making a claim through the small claims court if you don't get your refund in (say) two weeks.0

In that case if you know the time ask them to check if there is any recording. Failing that it seems to me that your odds are slim but by all means continue trying. You may get somewhere with their failure to provide a satisfacory service.0
