John Lewis - returning a tablet?

I purchased a tablet online from John Lewis. I collected it today instore. I do not like it and want to take it back. Their returns policy is not entirely clear, it says:
Terms & conditions
If you're unhappy with your purchase, please let us know. Unless faulty, we'd like this to be within 90 days of purchase
If you return your item to one of our shops and you'd like a refund but don't have your receipt, order confirmation or delivery note, we'll give you a gift card to the value of the current selling price. Ordinarily if you have your receipt or delivery note we'll refund the original debit, credit or charge card used to purchase
It's important that any unwanted item, unless faulty, is returned in a re-saleable condition. We'd expect this to mean that you've kept all original packaging and labels, and that it's undamaged and unused
We'll refund any delivery charges you've paid if you return an entire order (UK orders only)
Do you think they will take it back and give me a refund?

The "it's undamaged and unused" concerns me. I have switched it on but not used it really for more than 5 mins0

You would have to speak to them - but it is used now, regardless of how long for. What makes it unsuitable?0 -
Don't the distance selling regulations apply?

Yes they do - well, it's now the Consumer Contracts Regulations, but they will apply and you should be allowed to switch a tablet on to check its suitability.0

would that depend if it has been used ie anything installed, any names on it etc, having said that I would expect JL to refund0 -
If you do a reset on the tablet it puts it back into "as new" condition, as long as you haven't dropped/scratched it etc.
I returned a tablet to JL about 18 months ago and there was no problem at all - it was boxed as new with the film on the screen etc.0 -

Indeed, which is why I said "switched on", any updates made manually could be a problem, although as Camelot suggests a restore would work anyway. I might have posted a bit more but I'd been up for almost 24 hours having just got home from the referendum count in Perth so I needed my bed
