Expedia 100% Cancellation Charge..

Expedia wont let me cancel my holiday, my idiot brother booked a family holiday using my mothers credit card; this was without our knowledge and now we need to cancel it.

After phoning expedia and explainign the situation they referred us to point 2.3 of their terms and conditions which states they offer a 100% no refund policy, so if we cancel we pay the full cost of the holiday anyway. Can this be legal?

Does this affect my statutory rights?

and what the hell can i do about this because my family stand to loose over £700's !

Please help!

    You have my sympathy (a lot - it's happened to me recently) but if they clearly stated it was non-refundable I'm not sure that you have a strong complaint. You're looking for goodwill from them.

    Ultimately this is how prices are kept cheap.

    Can you provide a link to the terms and conditions - I can't find them.

    Would be interested if anyone has sued in this circumstance?

    Sorry I havent got a link as they appear in the members itinerary area of the site.

    The terms and conditions differ depending on deals. They do offer some refund or exchange options on most of their deals, this just happend to be a 'special promotion', they say they cant do anything about it because its booked directly with the hotel and airline.

    I hope somebody sues, i've never heard of a situation where you are tied down like this. :o(

    Sue for what and on what basis? Remember the Distance Selling Regulations are excluded from most leisure services.

    A lot of tickets and prices are like that especially cheap ones. I have 5 tickets for the USA this Christmas. If I don't go....poooooof end of dosh. Do you have any travel insurance that may cover cancelation? or does the credit car have such? Worth a try.

    Not an ideal solution, but if all fails you could try to find out how much it will cost to have the names changed for the holiday and sell it to someone else. Perhaps sell it on ebay, explaining the situation and that name change fees will be charged (or maybe include these fees in the cost of the auction starting price). Just a thought...

    last year my daughter got chickenpox the day before we were due to go on holiday :eek: ANyway... I had booked two hotels through Expedia. Contacted them to cancel and I got partial refunds on both hotels we had booked. There was a small amount taken off for late notification but I wasn't complaining (and we got it back through travel insurance anyway). If this was an extra cheap special offer perhaps this doesn't apply , sorry, don't know, just thought I'd let you know I had had money back from them last year.

    Im going to check out my mothers card protection plan and also see if travel insurance covers this sort of cancellation, im keeping my fingers crossed!

    Sorry, wasn't trying to sound like a killjoy on this one. I guess technically it could be counted as credit card fraud, your bro didn't have authority to use your mum's credit card. But I guess you know where that would lead to.

    I'm presuming your bro is under 18?

    Also is there any chance you would be able to take the hit and go on holiday?

    Another suggestion is to write in (note, not phone or email) to Expedia head office and ask them to look into it on the hope you can come to some arrangement with them??

    I don't see that any insurance will cover this. It's just disinclination to travel which is specifically excluded on all policies.

    I think munki's suggestion is by far the best and the only credible way to deal with this situation.

    I also don't see why you think there's anything wrong in the company's attitude - most lastminute or special value flights and holidays are un-refundable which is precisely why they are cheap.

    Whilst it IS unauthorised use of a credit card, I can't see that getting your brother arrested for fraud is a good idea so I shouldn't pursue that idea.
