she has also claims pip too the lower care

In that case no non dependent deductions will be made.

Although the link refers to HB the same applies to Support for Mortgage Interest.

(Just a tip, try to give all the information in one go :))

Just wondering does your mum get Carer's Allowance for looking after you, this would increase her benefits by £34.20 per week if not and also depending on who else lives in the house she may qualify for the severe disability element, do check it can increase benefit entitlement a lot.
Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.
  • Thanks so far to be absolutely clear this is the situaiton:

My mum is disabled herself, for this she gets Local Housing Allowence, Council Tax benefit, Income based ESA and PIP lower daily living. She claims carers allowence for me but gets a reduced rate because of my siblings who are under 16.

I'm a disabled full time student at university living at home with my mum. I get DLA - MRC and HRM, Contributions based ESA Support Group from Incapacity migration. I also get a student loan. Since being eligible for benefits at 16 I have been in school, college and now university full time.

I am thinking about starting a paid placement, through the university. I know I will loose my ESA, but I value the opportunity. I have been told Tax Credits are an option. My placement is around 12-13k for the year, and because im still a full time student I get a loan this year for £1,700 and exemption from council tax.

I do not pay anything to my mum for living with her, aside from buying my own food.

Hopefully this makes the picture a little clearer.

I've never had a job before, and I really want to make a start and see whats possible and what isnt.

Will she loose anything, will i need to pay her anything? will i loose anything apart from ESA?

    Thank You :)

Is she still claiming child benefit and tax credits for you?
  • Nope i'm in my 20s
  • The DWP have said she will loose money, but all the info I've read suggests she shouldn't. Also id have to provide a reason and proof of stopping my placement to claim it again within 12 weeks if need be??

How would I go on in 12 months time claiming esa again, will I have issues despite being a disabled student? The mortguage payments are from ESA and not the council. Acording to online sources the same non dependant rules apply to this, but she gets pip care so shouldn't loose anything?

You still confuse me - does she live in a shared ownership property where a person can be both a tenant (claiming Housing Benefit/LHA) and an owner (claiming Support for Mortgage Interest) as you keep mentioning LHA and mortgages whereas a full tenant only gets HB/LHA and a full owner can receive SMI. Someone in an SO can qualify for both.

What do you mean by 'the mortgage payments are by ESA'? That's too vague. Do you mean your mother qualifies for SMI because she gets ESA? Or something else?

A table like this one makes it clear whether you or your mother are exempt from the non-dependent deductions.

Does your mother receive the care component of disability living allowance or the daily living component of Personal Independence Payment (PIP)?

She receives daily living component of PIP, which would result in no deductions being made.

The DWP have said she will loose money, but all the info I've read suggests she shouldn't.

What money and what is this sum? What specific benefits are affected and by how much? Can you please be a bit more specific otherwise the advice is likely to be wrong or speculative.

Non-dependent deductions, the reduced sum paid towards housing benefit and council tax for the tenant that is applied to some households due to the employment and benefit income of adult children, is something administered by the local council (not the DWP).
  • She gets SMI,income based ESA, PIP daily living lower rate and child tax credits.

I get Middle rate care, higher rate mobillity DLA, contributions based ESA (from incapacity). I'm doing a full time student placement for a year, £13k, 37 hrs pw for the year and then returning to university to finish year 4.
