Contract Termination

OK I am trying to reduce our monthly outgoings because I don't have a job. I recently had to challenge 3 because the Samsung galaxy S4 zoom they supplied kept overheating. They agreed to replace it with a new Sony handset but it was a faff getting it. I am now getting desperate to reduce my outgoings, so would I be able to invoke the Consumer Credit Act since I have paid over a third of my contract. Could I hand the phone back and cancel my contract at no extra cost to me, since I won't be able to afford the payments anymore?

    The simple answer is no you can't, the contract is a service agreement, the phone is separate from the contract

    Not for those reasons no. Unless you end up in genuine financial hardship, and go through some kind of debt relief.

    Here's a thought: sell the phone, use it to pay off the contract? Not sure how much its worth and all though?

    Ignoring the fact that mobile contracts aren't covered by the CCA, why do you think that the act allows getting out of a credit contract after paying 1/3 back?

    Thanks Grumbler. I thought they might be covered. Most Cc agreements have a standard paragraph that if you pay 1/3rd, you can cancel it by handing goods back. Good advice though, hadn't thought about selling the handset. It's a Sony Experience Z1 which I know is worth more than the Samsung I had. Will look into it.

    So worth anywhere between £260-425 new, depending on the model. Even if second hand could go along way to paying off most of the contract. How much is it per month? And how much time left?
