sofa repair / replace

Hi I bought a pair of leather sofas last year from a reputable old style furniture shop as I was unhappy about the low cost "advertised on tv" places ( you know who I mean) After about five or six months the seat cushions started to misshape at the front edge so we spoke to the shop and they sent a guy out to see them, then they sent an engineer out to make a report which they sent to the factory (in Italy) where a repair was ok'd. New (upgraded) sprung /foam cushion insides were sent and an engineer fitted them at my house. A few months after fitting these new upgraded cushions they started to go at the front edge again and the interior springs started to come apart and leave a large valley in one of the cushions and a smaller one in the other cushion. The shop sent a guy and then an engineer to look and make a report and the company want to repair it again with more upgrade springs, foam and webbing but I feel that I have given them the chance to put this issue right and I now want a replacement how do I stand, am I being reasonable or should I give them the chance to do another repair. Sorry for the epic tale but It's hard to condense it. Each time the people come out to see or do a repair I have to have a day off work so I've lost 4 days of my holidays so far!
Thanks Scimitargt

The shop are saying that I "HAVE" to give the manufacturer a second chance at putting this right, is this correct. The first repair just made the thing much worse and lasted less than 12 weeks.
Would love some input on this as I have refused to the repair unless they are prepared to offer me a 10 year warranty (which I don't think they will!) so I will be looking to start the ball rolling towards possible legal action?

Unfortunately theres nothing in law (yet) saying how many repairs they're allowed.
All the law currently says is that a repair (or replacement) should be carried out within a reasonable time and without causing significant inconvenience.
Personally I'd let them try a 2nd time and if that doesnt work, then push for a replacement or refund.
If you paid by credit card you could also try your card issuer for a section 75 claim if they fail to repair it the 2nd time. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Thanks for that, I am reluctant to let them repair it again after the last time.
I paid cash for the sofas so I can't go back to a credit card agreement.
My wife did comment that if we had bought the sofas on credit we would probably had more of a response, would this the case?

You should always buy anything over £100 on a credit card, doing this makes the company and the credit card company both liable.
So any dispute would be raised with the cc company if the sofa company didn't sort it.
It is called a Section 75, please google it, it explains it fullymake the most of it, we are only here for the weekend.
and we will never, ever return.0 -

Basically when you buy/pay a deposit for goods valued at more than £100 on credit, they are jointly and severally liable. Meaning you have the same rights with your card company/finance provider as you do the retailer themselves.
If the card company reject your claim then you also have the benefit of being able to refer your claim/complaint to the financial ombudsman. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
With the last repair only lasting a couple of months, would we have a right to say we are unhappy with the repair and don't want it repairing again. I am worried that the repairs will just last out the 12 month warranty and then give trouble, am I being unreasonable in asking for the manufacturer to stand be their workmanship and product and offer an extended warranty?

Also the manufacturer wants the sofas back at the factory (in Italy), would the shop have to supply me with a sofa while mine are being repaired?

You may want to point that requirement out to the seller.0 -
I did see the earlier post but did not understand it completely. The manufacturers want them back in Italy but the shop says that he can get them repaired at my house (like the first time) through a third party. I really would like this sorted and I wonder if the sofas going back to the factory is the only way that I can be sure of getting the items back in good serviceable condition (while they are at the factory they can have a good check over, a repair at my house will only be fitting the parts that they think may be the trouble).

I think the forum needs fixing.
(If you quote the posts you actually see the original texts, so it's just the inline/display filters that need fixing).0
