  • It doesn't look like the space is part of the leasehold, just that I am allowed to park there.

    If I upload a picture of the sign, would someone be able to confirm whether they have got anything wrong?

    Signs are always able to be argued and that one is no different. So, have you added the usual 'unclear signage' and 'no standing to pursue charges in the courts in their own name' paragraphs that you will see in all examples linked in 'How to win at POPLA' (in post #3 of the Newbies sticky thread near the top).

    You do realise you are fast running out of time?? A POPLA code lasts just 28 days from the day OPC generated it and going by your thread that was a month ago. You may well have missed your POPLA deadline now so check the POPLA code with the POPLA code checker which is also in post #3 of the Newbies thread.

    Should have sorted this out 3 weeks ago, it was easy, the template examples are here to copy in minutes and most posters sort it the same day or at least the same week as first posting. If you have missed the POPLA deadline, submit the appeal online to POPLA anyway and if it gets kicked out as too late then ignore OPC from then on (except if you get real court papers which you'd have to be a bit quicker to deal with - we can help but it is up to you to do things in time).

    Do not pay too much attention to CM's post above, she, and many others on here, treat PoPLA as though it is the answer to all parking problems, it is not. There is a vast difference between landowners properly parking on their own land and overstayers, bilkers, and BB bandits.

    In cases where a PPC harasses a property owner properly parked in their own space, Popla is as relevant as an eggcup full of lukewarm urine.

    What happens if you appeal this to PoPLA and win, the CPN is cancelled and OPC will continue to harass you whenever you park in contravention to their meaningless T&C.

    However, if you ignore, what will happen? Almost certainly you will get a few begging letters, perhaps a few 'phone calls from a DCA, and it will go away.

    I would venture that their chances of taking this to court are nil. They have been to court and paid dearly for their hubris, having had costs of over £37,000 awarded against them, and this case would have even less merit than those against Thurlow and Shaw.

    Yep that's an option, DP. But as you know most new posters want to stop the whole thing = the answer for them IS POPLA. Nothing to stop him also opting out of the permit scheme and objecting to the managing agent about letting this notorious criminal thug ex-clamper loose near the residents' cars.

    Yes CM, MOST do, but most are in part responsible for the predicament in which they find themselves: they overstayed, they left the site, they bilked, they parked in the wrong place, they failed to enter a registration number, all of which are legitimate requirements. None of these things took place in this instance.

    You will have noticed that I rarely give advice to sinners on how to beat PCNs. This is because I am constantly having my own spaces invaded by such behaviour, I can well understand why a management company should wish to protect its clients from parking abusers.
    You never know how far you can go until you go too far.
