    That's a really hard one

    Do you pay:
    £70 to scammers
    £40 to the same scammers

    Or

£16 to someone who will ensure the scammers get £0

What to do, what to do.

Are we not allowed to call Parking Eye Scammers? What about Scum Bags? or Parasites?

    We need guidance :D

It seems to go in cycles.

Parking Eye lean on MSE, MSE start removing posts / signatures / posters, we all complain like hell and eventually they stop removing ...... until the next time [STRIKE]the scammers[/STRIKE] Parking Eye complain again.

When you look at the 3 examples of PE POPLA appeals as linked in 'How to win at POPLA' in post #3 of the newbies thread, where do you see stuff about being taken ill or other mitigation? You don't!

Accepted, nothing in the templates about being ill or busy carparks, I was just hoping to find another person whose scenario was the same as mine, and I haven't found one although admittedly there are SO many to trace from the appeals allowed, I have probably only seen the tip of the iceberg.

However, looking at the NEWBIES linked thread https://forums.moneysavingexpert.com/discussion/comment/65370663#Comment_65370663 and in post 20 point 2 it talks about " in darkness no signs are visible", and in linked thread https://forums.moneysavingexpert.com/discussion/comment/66321761#Comment_66321761 post 5 point 4 is says "It was approaching darkness and .."
As my PCN was at timestamped midday, can I still say the signs aren't lit etc? - which they are not, and they are too high for headlights.

yes you can use these types of evidence, but "what happened" is mitigation and so not allowed or considered in a popla appeal which is why you wont find those details

popla dont care about "what happened" , they are not bothered if people are ill or had car trouble or the car parks were busy, that is a list of excuses or mitigating circumstances, yet they clearly state that mitigation is no grounds for appeal on their website (did you look there for guidance ?)

the point here is people on here have been helping hundreds or thousands of people over the years so you need to quit arguing and accept what you are told by those of us "in the know"

when you stop looking at mitigation and realise its a game you will win by not getting mad and getting even, you will eventually see why we tell you what we tell you , also why some things are not mentioned because they are not relevant

signage and lighting etc are relevant and so should be included in any appeal, as should PFA 2012 , not a gpeol , no contract , anpr etc

    good luck

ps:- the actual choices are as follows
    Do you pay: ?

    £70 to sc*mmers

    £40 to the same sc*mmers

    Or

£16 to someone who will ensure the sc*mmers get £0

    £0.00 by doing it yourself

There are other generic signage paragraphs that simply talk about height and difficulty to read with no mention of light conditions. Chose one of those instead.

Or I could use parkingticketappeals.org.uk - who charge £16 and 'guarantee' to pay your fine even if they lose. Anyone used them?

PTAS are good at what they do, and the people that do the work for them get paid.

I'm not aware of them having had a single complaint on the forum, and as the people behind it are regular posters here, I don't think you'll see any complaints.

    Interest declared, see my sig.

You don't need to find a case the same at all - the fact it is PE is enough. The Newbies thread says the details/circumstances don't matter a jot, because they don't.

You just remove the stuff about 'dark' and 'unlit' of course. Both you and this poster (below) are pointlessly procrastinating and panicking about absolutely nothing at all, obviously just remove the odd word or sentence from the template, chuck it in online to POPLA, tick 3 out of 4 appeal boxes and sit back and win!

    https://forums.moneysavingexpert.com/discussion/comment/66464769#Comment_66464769

This is so simple, we do this every day, hence the template. It wins. Calm down! If you really can't hack it, pay £16 to PTAs, who may well use the same sort of appeal!

Seriously I am not arguing, just asking questions to help me understand.

    I have another question...
Some people have mentioned about getting an 11 page letter from PE or a letter mentioning a court case ParkingEye v Barry Beavis and Martin Wardley, I had nothing like this. Mine was just one page with a paragraph saying my appeal was rejected on the basis that the maximum time allowed was exceeded.
The rest of the letter was advising about the popla appeals service and how to pay up. There were 3 more pages of information produced by popla plus the appeals form.
So my question is, why do some people get different letters?

I am working on the popla appeal letter and will post it up here soon and hope some kind people will review it. Thanks again in advance.

I suspect PE have a couple of different template options of rejection letter and Sharon on one desk just happened to hit that button on her PC to generate your rejection letter whilst Tracey on the desk next to hers, prefers the longer version. It's all computer generated so 'worry ye not'. You will WIN.
